“We are pleased with the decision by the federal court today which allows the Smoke-free Act to be implemented on April 15th. Proposed rules are available as guidance on the web site. These proposed rules provide guidance on what indoor places are subject to the Act, exterior areas including distance from an interior non-smoking area which are subject to the act as well as places that are exempted from the Act. Upon publication in the New Jersey Register, (week of May 15th) there will be a 60 day opportunity for public comment on the proposed rules. During that time the Department will accept comment on any of the proposed rules including definitions, prohibited smoking areas including the 25 foot setback from interior non-smoking areas, the process for cigar bar exemption, and the enforcement process. The Department of Health and Senior Services will also hold a public hearing during the public comment period. Following the public comment period, the Department will review the comments and prepare a final adoption for publication. | |
