The Fiscal Year 1997 Appropriations Act (PL 1996, c.42) effective July 1, 1996
contains the following language in the General Provisions section of the Act:
7. No funds shall be expended by any State department in the Executive Branch
in connection with a contract for the production of films or videotapes unless
the New Jersey Public Broadcasting Authority (NJN) is invited to submit a bid
or price quote as part of any formal or informal contract award process.

Therefore, you are advised that in procuring services for the production of
films or videotapes, you must permit the New Jersey Public Broadcasting
Authority to submit a bid or price quote.

Prior to submitting purchasing requests to the Purchase Bureau for film/video
production exceeding $10,500, using agencies should solicit a proposal from New
Jersey Network. If the proposal is found acceptable, the contract can be
entered into directly with New Jersey Network through accounting procedures.
However, if the New Jersey Network proposal is not acceptable to the agency,
based on NJN's inability to meet time or technical requirements, the Purchase
Bureau will handle the transaction either as an advertised bid or if
appropriate, a waiver of advertising. Documentation must clearly demonstrate
that New Jersey Network was provided an opportunity to submit a quote for the
project.

Concerning film/video production purchased via direct purchase authority,
agencies must obtain a proposal from New Jersey Network as part of their
required three (3) quotes as per Circular Letter PC-23G. Any procurement
questions should be directed to Enrico G. Savelli, Supervisor of the Purchase
Bureau at 609-292-4751.
