Policies and Standards | State of New Jersey Online Disclaimer Policy

Purpose

This To ensure that New Jersey Executive Branch Agencies' Web or online services contain appropriate disclaimer statements.

Scope

This policy applies to all public Web sites of State agencies in the Executive branch of Government other than independent State agencies that operate Internet Web sites as a public service.

Definitions

Independent State agencies are authorities, boards, commissions and other agencies of the State of New Jersey, which are not subject to the policy supervision and control of the Governor. An example of an Independent State agency would be the New Jersey Transit Authority. Intrusion detection system is a type of security management system for computers and networks.

An intrusion detection system gathers and analyzes information from various areas within a computer or a network to identify possible security breaches.

Online is the condition of being connected to a computer or a telecommunications system. For the purposes of this policy, the term is used to describe a connection to the Internet.

A Web site is a collection of HTML (Hypertext Markup Language) files on a particular subject that includes a beginning file called a home page. For example, most companies, organizations, or individuals that have Web sites publish a single address. This is their home page address. From the home page, you can get to all the other pages on their site.

Policy

All New Jersey Executive Branch Agencies that engage in online activities or electronic commerce should provide users with statements disclaiming legal liability from damages resulting from the access of an agency Web site, statements disclaiming liability pertaining to links to other sites, statements disclaiming liability for erroneous or outdated information and disclosure statements regarding intrusion detection systems.

In addition, the disclaimer statement should make clear to users that the information provided is on an "as is" basis and the user assumes the risk when relying on such information.

The statements shall be developed in consultation with agency legal counsel. Links to an agency's disclaimer statements shall be displayed on the home page of all agencies subject to this policy.

Designate a person or persons to ensure compliance with this policy.

Compliance

Agencies shall comply with this policy within 90 days of its effective date.
