Disability
Determinations
The New Jersey Disability Determination Services (DDS)
is a division of the Department of Labor and Workforce
Development fully funded by the Federal Government, and
is responsible for developing medical evidence and
determinating whether New Jersey residents are disabled
under Social Security disability law. While the Social
Security Administration handles the technical eligibility
issues, a two-person adjudicative team consisting of a
physician or psychologist and a disability adjudicator
makes the determination on medical, vocational, or legal
eligibility. After DDS makes the determination, it returns
the case to the Social Security Administration who then take
appropriate action: If the claimant was found disabled, SSA
prepares necessary payment actions. If the claim was denied,
SSA retains the file in case the claimant wants to appeal.
Vocational Rehabilitation
Services
The mission of the New Jersey Division of Vocational
Rehabilitation Services is to enable individuals with
disabilities to achieve employment compatible with their
strengths, priorities, needs and abilities. If you have
a disability that is preventing you from working, or
which is endangering your present employment, you may
wish to submit a referral for services.
Temporary Disability
Insurance
Under
the New Jersey Temporary Disability Benefits Law, cash
benefits are payable when you cannot work because of
sickness or injury NOT caused by your job. New Jersey
is one of only five states which provides compulsory
temporary disability insurance for workers. Workers
whose employment is covered by the New Jersey Unemployment
Compensation Law are also protected by a mandatory disability
insurance system. Workers who become disabled within
14 days of their last day of work in covered New Jersey
employment may be covered for disability insurance under
the State plan or an approved Private Plan. Inquiries
concerning your own coverage may be directed to your
employer. There is a third program for those whose disabilities
begin more than 14 days after the last day of work.
This program is known as "Disability During Unemployment".
Workers' Compensation
As a partnership among government, industry, and labor,
the NJ Division of Workers' Compensation seeks to establish
an equitable balance between the needs of injured workers
and the needs of employers. With a commitment to the
highest standards of professionalism, our mission is
to ensure that proper benefits are paid to workers who
are injured on the job, in addition to enforcing the
law requiring employers to obtain insurance coverage
for their employees.
