Adopted New Rule: N.J.A.C. 13:44E-2.6

Take notice that the State Board of Chiropractic Examiners adopted a new rule, effective December 3, 2001, N.J.A.C. 13:44E-2.6, Patient record review. See 33 N.J.R. 4140(a). As the Board had already adopted a rule at N.J.A.C. 13:44E-2.6, Referral fees, effective August 6, 2001 (see 33 N.J.R. 2683(a)), the new rule adopted December 3, 2001 will appear codified as N.J.A.C. 13:44E-2.6A in the 12-3-01 Code update.

Take further notice that the notice of adoption for N.J.A.C. 13:44E-2.6, Patient record review, did not include the names of approximately 5,444 commenters who submitted comments in support of the proposal. Omitted from the text of the notice of proposal was the following language explaining the non- publication of those names, which should have appeared after the sentence, "The Board has received several thousand general comments of support from members of the public.", under the heading "Consumer Supporting Comments" at 33 N.J.R. 4142: "At the discretion of the Office of Administrative Law (OAL), in accordance with N.J.S.A. 52:14B-7(c), the names of these approximately 5,444 commenters are not reproduced herein. That list of names is available for review from the OAL (PO Box 049, Trenton, NJ 08625-0049) and will be retained by OAL as part of the permanent file on this rulemaking."
