NOTICE OF ADMINISTRATIVE CORRECTION LAND SURVEYORS;
CONTINUING COMPETENCY CREDIT-HOUR REQUIREMENTS


N.J.A.C. 13:40-11.3

Take notice that the Division of Consumer Affairs has discovered an error in the text of N.J.A.C. 13:40-11.3(b). N.J.S.A. 45:8-35.2 establishes a maximum of 24 credits of continuing professional competency that the State Board of Professional Engineers and Land Surveyors shall require a land surveyor licensee to complete during a biennial license period. Utilizing the Board's credit unit, the professional development hour (PDH) (see term definition at N.J.A.C. 13:40-11.2), N.J.A.C. 13:40-11.3(a) requires, as a condition of license renewal, that a minimum of 24 PDHs be completed in the preceding biennial license period. Effective October 7, 2002, the State Board of Professional Engineers and Land Surveyors amended N.J.A.C. 13:40-11.3(b) to increase, from eight to 12, the maximum number of PDHs that land surveyor licensees may carry over into a succeeding biennial license renewal period. See 33 N.J.R. 3241(a) and 34 N.J.R. 3532(c). However, inadvertently overlooked in the promulgation of the amendment was N.J.S.A. 45:8-35.10, which,effective August 4, 1993 as P.L. 1993, c.39, ß 8, established eight as the maximum number of credits that could be carried over. Through this notice of administrative correction, published pursuant to N.J.A.C. 1:30-2.7, the carry over maximum is conformed to the pre-existing statutory limit.
