ALCOHOL AND DRUG COUNSELOR COMMITTEE
PUBLIC SESSION MINUTES April 24, 2009 I. CALL TO ORDER This scheduled meeting was called to order at 9:39 a.m., in the Sussex Conference Room, 6th floor, 124 Halsey Street, Newark, New Jersey. II. ROLL CALL Present:
Committee Chairman, Edward Reading Recused: Committee Member, Lorenzo Puertas Until the matter is resolved, Public Member, Lorenzo Puertas recused from attendance based on services he provides related to the profession that may be a possible violation of the statutory requirement for public board members.
Announcement of quorum was made by Committee Chair, Dr. Reading. III. APPROVAL OF MINUTES On a motion made by Sylvia Lippe, seconded by Jamie Lugo, the minutes of the March 23, 2009 public session meeting were approved as corrected. IV. PUBLIC COMMENT There were no members of the public present. V. LEGISLATIVE/REGULATORY Notice of Rule Proposal: N.J.A.C. 13:34C-1 et seq. The Committee was provided with a copy of the New Jersey Register April 20, 2009 published proposal for the revisions of the regulations pursuant to N.J.S.A. 45:2D-1 through 45:2D-17. The public comment period ends on June 19, 2009. VI. CORRESPONDENCE Raquel Mazon Jeffers, Director, Division of Addiction Services The Committee reviewed a copy of a memo dated March 20, 2009 and addressed to Commissioner Jennifer Velez. and directed that a note be forwarded to correct the reference to the composition of the Alcohol and Drug Counselor Committee. Pursuant to N.J.S.A. 45:2D-12, five members are to be appointed with one being a public member, two licensed alcohol and drug counselors and two certified alcohol and drug counselors. VII. DAS MATTERS The Committee continued its review of the Division of Addiction Services draft licensure residential regulations. The Committee previously noted the need for the revision of the language at N.J.A.C. 10: 161A-1.9(a)ii to clarify that a CADC is prohibited from making diagnoses. Additional Committee comments include: 1. N.J.A.C. 10: 161A-1.3 The definition of ‘ASI’ should include . . . contribute to his or her substance use disorder and assess the degree of the client’s substance abuse disorder . . . 2. N.J.A.C. 10: 161A-1.3 The definition of ‘Clinical supervision’ should be amended to include the language of the definition of "Clinical supervision" as specified at N.J.A.C. 13:34C-6.1. Reference to the Committee should be corrected to read: "State Board of Marriage and Family Therapy Examiners, Alcohol and Drug Counselor Committee." 3. N.J.A.C. 10: 161A-1.3 It is suggested that the definition of "Discharge plan’ be amended to include reference to the current "Chronic disease model.’ 4. N.J.A.C. 10: 161A-1.3 The Committee questioned whether the definition of "Facility’ would apply to criminal justice halfway houses that provide alcohol and drug counseling as a primary function. 5. N.J.A.C. 10: 161A-1.3 It is suggested that the definition of "Family" be amended to add; "Family" means immediate kindred and spouse. . . " 6. N.J.A.C. 10: 161A-1.3 The Committee suggests that the word "Physician (MD/DO)" is more appropriate than the term "Practitioner." The Committee questioned the inclusion of " a podiatrist" as it is not clear what the function of a podiatrist would be in an addictions facility. 7. N.J.A.C. 10: 161A-1.3 The Committee found the definition of ‘Supervision (direct)" to be misleading, unless it refers to non-clinical supervision. It does not define clinical supervision. 8. N.J.A.C. 10: 161A-1.8(a)4 It is suggested that the experience requirement specified for a director of substance abuse counseling services would create an extreme limitation on current licensees working in this capacity. The Committee also suggested that the master’s degree requirements be consistent with the provision of N.J.A.C. 13:34C-2.2 (b). Finally reference to the Alcohol and Drug Counselor Committee should be corrected to read: ‘"State Board of Marriage and Family Therapy Examiners, Alcohol and Drug Counselor Committee." 9. N.J.A.C. 10: 161A-1.9(a)ii The Committee previously noted the need for the revision of the language at N.J.A.C. 10: 161A-1.9(a)ii to clarify that a CADC is prohibited from making diagnoses. 10. N.J.A.C. 10: 161A-1.9(d)2 It is noted that both the CADC and LCADC may provide an assessment, while the LCADC credential is required in order to render a diagnosis. VIII. APCBNJ MATTERS The Committee accepted as informational the APCBNJ April 2009 newsletter. IX. OLD BUSINESS A. The Committee accepted as informational the Center for Alcohol and Drug Studies Class Rosters and Certificates of Completion - March 31, 2009

B. 2009 School of Alcohol and Drug Studies: The Alcohol and Drug Counselor Committee voted to approve the review of the course work submitted February 20, 2009. The review includes disclosure information provided in the Committee’s 2008 course reviews. To help clarify any confusion among prospective students as to whether certain courses will count towards the initial licensure requirements, it is suggested that language be published with the Rutgers course descriptions – linking the Committee approval numbers to the respective regulatory citation. It will be emphasized that the Committee cannot ensure that the course work will be accepted by the certification/licensing authorities in other jurisdictions. Therefore, all promotional literature for the two programs and course work should include the following notification as previously approved by the Committee: Approval by the Alcohol and Drug Counselor Committee does not ensure that course work will be accepted for initial certification or licensure in other jurisdictions or by the Certification Board. The Committee approval is for initial New Jersey state certification and licensure purposes only. To facilitate the review of initial licensure candidates, it is anticipated that the approved course title, date, instructor and approval number will be printed on the certificate of completion for each participant. X. NEW BUSINESS A. Robert Wood Johnson Medical School - Professional Renewal in medicine Ethics course: "A Boundaries Course in Professional Ethics for Physicians.’ In response to a phone inquiry related to the requirements specified in the Filed Consent Order in the matter of Luis E. Hernandez, the Committee determined that in lieu of the above cited course, a three-credit, CACREP- accredited, graduate course in professional ethics would be acceptable. B. FY2009 Budget Report The Committee reviewed and accepted as informational the report for 1st half of Fiscal Year 2009. OLD BUSINESS Substance Abuse Evaluator; Title and Function A. Rhonda Berliner-Gold, Esq. and principals of the Drug Court are scheduled to address the Committee on May 15, 2009 regarding Ms. Berliner- Gold’s letter dated March 25, 2009. The Committee was informed that Lynsey Johnson, Esq. called to report that she and PANJ representatives will attend the public session meeting as well. XI. FILED CONSENT ORDERS

EXECUTIVE SESSION The Committee will move to Executive Session to conduct investigative inquiries, review criminal history background reports, pending disciplinary and confidential matters. XIV.
