I CALL TO ORDER

The regularly scheduled meeting of the Board was called to order at 9:30 am in the Union Conference Room on the third (3rd) floor at 124 Halsey Street, Newark, New Jersey

II OPEN PUBLIC MEETINGS ACT

The statement required by Chapter 231, public laws of 1975, the "Open Public Meetings Act," was read and it was announced that notice of this meeting was prepared in the office of the Board of Architects and mailed to the Secretary of State, the Newark Star-Ledger, the Trenton Times, the Camden Courier-Post, the Record and the Atlantic City Press.

III APPROVAL OF MINUTES

May 8, 2008

ACTION: Mr. DeMassi motioned to approve the minutes as presented. Mr. Kniesler seconded the motion. It passed unanimously.

IV ANNOUNCEMENTS

Executive Director Hsu announced the following:

– David Szuchman is the new Director of the Division of Consumer Affairs check article for some facts
– Susan Wise, NCARB Director of External Affairs has resigned effective September 2008
– Receipts for tolls and parking are to be submitted to the Board office by the end of June.
– Electronic transmittal of NCARB blue cover will be emailed for downloading by the Board.

Mr. Zaccone announced that he and Mr DeMassi will be attending the NCARB Annual Conference on June 26 & 27, 2008 in Pittsburgh Pennsylvania.

V OLD BUSINESS

A Correspondence

On April 24, 2008 the Board reviewed a copy of a March 5, 2008 letter from Barrett D. Kolton of Mobility Consulting Group, LLC, requesting a written opinion that he does not need a license for his consulting business is attached for the Board’s information. Subsequent to reviewing this letter, Mr. DeMassi motioned to send a letter requesting more detailed description and process of his involvement; submit a list of all New Jersey projects and include the name/s of the architects for each project. Mr. Joshi seconded the motion. It passed unanimously. On May 8, 2008, the Board reviewed Mr. Kolton’s response to the Board’s request for more information. Mr. DeMassi motioned to advise Mr. Kolton that it does not appear that he needs an architectural license from this Board, however, the Board will refer his May 1, 2008 letter to the Home Improvement Unit to determine if he is required to register as a Home Improvement Contractor. Also request verification from Appel Design Group whether the information from Mr. Kolton is correct. Mr. Joshi seconded the motion. It was unanimously approved.

5/22/08 Laurance Appel’s response to the Board’s request for more information is attached for board review.

ACTION: Mr. DeMassi motioned to find no cause for action. Mr. Horii seconded the motion. It passed unanimously.

B Correspondence

Copy of a letter dated March 17, 2008 from Jason Lusardi, Architect, requesting a clarification of the delineation of responsibility of the licensed architect is attached for review and discussion. On May 6, 2008, the Joint Committee reviewed a copy of an April 28th memo from Arthur Russo, Executive Director, Board of Professional Engineers & Land Surveyors with the Board’s opinion to Mr. Lusardi’s correspondence. On May 6th, after some discussion, the Joint Committee of Architects & Engineers unanimously voted to forward this matter to the Board of Architects for discussion and bring this matter back to the Joint Committee. On May 8th, Mr. DeMassi motioned to send a letter to Mr. Lusardi requesting that he provide information as to the type of building is this project ; what services did he, as the architect, provide? What services did the professional engineer provide? Advise him of our next Architect and Joint Committee meeting dates Mr. Joshi seconded the motion. It passed unanimously.

ACTION: Mr. DeMassi motioned to advise the Joint Committee of Architects & Engineers that the Board of Architects determined his projects are architectural and the contract should be between the architect and the property owner. Mr. Horii seconded the motion. It passed unanimously.

A Correspondence

Copy of a May 9, 2008 memorandum from Kim Kerker, Assistant Director, Communications/Art Director, NCARB regarding the 2008 NCARB Resolutions to be acted upon at the 2008 Annual Meeting and Conference. The following resolutions are attached for board review:

Resolution 2008-01 - Handbook for Interns and Architects Amendment - Clarifying Training Setting for Earning Training Credit Under Non-US and Non-Canadian Architects

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-02- Model Law Amendment - Acceptance of the NCARB Certificate

ACTION: Mr. DeMassi motioned to support this resolution. Mr. Horii seconded the motion. It passed unanimously.

Resolution 2008-03- Bylaw Amendment - Clarifying the Roles of the Committee on the Intern Development Program and the Committee on Education

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-04- Handbook for Interns and Architects Amendment - Clarifying the Appeals Process Related to the Five-Year Rolling Clock and Adding Birth or Adoption of a Child as a Cause for Extending the Five-Year Period.

ACTION: Mr. DeMassi motioned to support this resolution. Mr. Horii seconded the motion. It passed unanimously.

Resolution 2008-05- Model Regulations and Rules of Conduct Amendment - Clarifying Knowledge and Skill

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-06- Handbook for Interns and Architects Amendment - Revising Exam Equivalents for the ARE

ACTION: Mr. DeMassi motioned to support this resolution. Mr. Horii seconded the motion. It passed unanimously.

Resolution 2008-07- Handbook for Interns and Architects Amendment - Reporting Requirement for IDP Training Units

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-08- Handbook for Interns and Architects Amendment - Employment Duration Requirement for IDP Training Units

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-09- Handbook for Interns and Architects Amendment - Allowing Certain Minimum Training Units for Completion of Qualified Emerging Professional’s Companion Exercises

ACTION: Mr. DeMassi motioned to support this resolution. Mr. Horii seconded the motion. It passed unanimously.

Resolution 2008-10- Model Regulations Amendment - Including Sustainable Design Among Health, Safety, and Welfare Subjects for Purposing of Continuing Professional Development

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-11- Model Regulations and Rules of Conduct Amendment - Taking into Account Generally Established Sustainable Design Principles Within the Rules of Professional Conduct

ACTION: Mr. Kniesler motioned to support this resolution. Mr. Joshi seconded the motion. It passed unanimously.

Resolution 2008-12- National Academy of Environmental Design

ACTION: Mr. DeMassi motioned to support this resolution. Mr. Horii seconded the motion. It passed unanimously.

Appendix B - ARE 4.0 Exam Equivalents

ACTION: Duly noted.

Appendix C - ID Reporting Examples

ACTION: Duly noted.

Appendix D - ACSA National Academy Proposal

ACTION: Duly noted.

B Regulations

Proposed amendment to N.J.A.C. 13:27-4.3 Architectural Registration Examination pertaining to the transition from 3.1 ARE to 4.0 ARE for eligible candidates was published in the New Jersey Register on May 5, 2008, is attached for board information. Deadline for comments is July 7, 2008.

ACTION: Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs was present to discuss this regulation. After some discussion, Mr. Horii motioned to write to NCARB to request an extension of the ARE 3.1 for New Jersey professional engineers due to unforeseen circumstances. Mr. DeMassi seconded the motion. It was unanimously. Also, the Board chair appointed board members Paul DeMassi and Howard Horii as a sub-committee to review NCARB web pages pertaining to contents of seven divisions of ARE 4.0 and report back to the Board.

C Landscape Architect Examination and Evaluation Committee

April 16, 2008 minutes

ACTION: Mr. DeMassi motioned to approve the Landscape Architect Committee minutes as presented. Mr. Horii seconded the motion. It passed unanimously.

D Interior Design Examination and Evaluation Committee

April 2, 2008 minutes

ACTION: Ms. Goté motioned to approve the Interior Design Committee minutes as presented. Mr. DeMassi seconded the motion. It passed unanimously.

May 7, 2008 minutes

ACTION: Ms. Goté motioned to approve the Interior Design Committee minutes as presented. Mr. Joshi seconded the motion. It passed unanimously.

E Information

1 NCARB Fast Facts dated May 22, 2008 pertaining to the ARE 4.0 and ACCELERATOR; Annual Meeting and Conference; and announcing NCARB Staff additions is attached for the board’s information.

ACTION: Duly noted.

2 NCARB Position Paper for the NAAB 2008 Accreditation Review Conference as well as summary of comments on the "NCARB Position Paper for the NAAB 2008 Accreditation Review Conference" from the NCARB Regional Meetings are attached for the board’s information.

ACTION: Duly noted.

F Legislation

It is requested by the Division Director's office that the Board review the following bills and advise if a position is taken.

1 S-1805 - Permits removal of State board, commission or independent authority member for failure to attend three consecutive meetings thereof without good cause.

ACTION: Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs was present to discuss this legislation. After some discussion, Mr. DeMassi motioned to support the legislation. Mr. Kniesler seconded the motion. It passed unanimously.

2 S-1815 - Requires legal action against certain licensed persons to be brought within two years.

ACTION: Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs was present to discuss this legislation. After some discussion, Mr. DeMassi motioned to support the legislation. Mr. Joshi seconded the motion. It passed unanimously.

2 ITEM NO. 57797 - RICCIARDI, Gabriel Jr. - Unlicensed / Contemporary Pools & Spas, LLC

ACTION: Subsequent to reviewing the revised advertisement, the Board unanimously voted to accept the new advertisement and close out this matter. CASE CLOSED.

X EXECUTIVE SESSION

At 12:25pm, Mr. DeMassi motioned to go into Executive Session for the purposes of reviewing the minutes and the disciplinary matters on the agenda. Mr. Kniesler seconded the motion. It passed unanimously.
