MINUTES I CALL TO ORDER The regularly scheduled meeting of the Board was called to order at 9:30 am in the Union Conference Room on the third (3rd) floor at 124 Halsey Street, Newark, New Jersey
OTHERS PRESENT: B. Michelle Albertson, Deputy Attorney General; James S. Hsu, Executive Director, Board of Architects; Margaret Hinkley, Secretary to Executive Director; Joseph Abello and Beverly Rankin of the Board of Architects. ALSO PRESENT: Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs; Arthur Russo Executive Director, Board of Professional Engineers and Land Surveyors. II OPEN PUBLIC MEETINGS ACT The statement required by Chapter 231, public laws of 1975, the "Open Public Meetings Act," was read and it was announced that notice of this meeting was prepared in the office of the Board of Architects and mailed to the Secretary of State, the Newark Star-Ledger, the Trenton Times, the Camden Courier-Post, the Record and the Atlantic City Press. III APPROVAL OF MINUTES July 10, 2008 ACTION: Mr. Zaccone motioned to approve the minutes as presented. Mr. Horii seconded the motion. It passed unanimously. IV ANNOUNCEMENTS It was announced that there are two Investigative inquiries scheduled for today @ 10:30am with the complainant and @ 1pm with respondent pertaining to ITEM NO. 57015. Executive Director Hsu announced that Patricia Schiripo will be present for discussion on the ARE. V OLD BUSINESS A Re-Organization of Board officers Mr. DeMassi opened the floor for nominations for Vice President. ACTION: Mr. Zaccone motioned to nominate Diane Goté to service as Vice President. Mr. Horii seconded the motion. It passed unanimously. B Regulations Proposed amendment to N.J.A.C. 13:27-4.3 Architectural Registration Examination pertaining to the transition from 3.1 ARE to 4.0 ARE for eligible candidates was published in the New Jersey Register on May 5, 2008, is attached for board information. Deadline for comments is July 7, 2008. On June 12, 2008, Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs met with the Board to discuss this regulation. After some discussion, Mr. Horii motioned to write to NCARB to request an extension of the ARE 3.1 for New Jersey professional engineers due to unforeseen circumstances. Mr. DeMassi seconded the motion. It was unanimously. Also, the Board chair appointed board members Paul DeMassi and Howard Horii as a sub-committee to review NCARB web pages pertaining to contents of seven divisions of ARE 4.0 and report back to the Board. On July 10, 2008, Mr. Horii indicated he received the information but the disk was not included. A copy of the disk was provided to him at the meeting. Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs was present to discuss this item with the Board. Ms Schiripo informed the Board that a letter was sent to NCARB requesting an extension for NJ Professional Engineer’s to continue taking the ARE 3.1 version instead of transitioning to take the ARE 4.0 version in June 2009. NCARB referred the Board discuss their concerns with Prometric, the agency who administers the computerized ARE. Subsequent to discussion, Mr. DeMassi motioned to authorize Ms. Schiripo to contact Prometric to meet with the Board at one of its regular board meetings to discuss the Board’s concerns. Also advise the Board of Professional Engineers when this meeting will take place, if they would like to attend the public session meeting. Mr. Horii seconded the motion. It passed unanimously. 7/24/08 Mr. DeMassi and Mr. Horii are to present their report to the Board. ACTION: Patricia Schiripo, Regulatory Analyst, Division of Consumer Affairs and Arthur Russo Executive Director, Board of Professional Engineers and Land Surveyors were present for this discussion. Ms. Schiripo informed the Board that both she and Executive Director Hsu spoke with Ms. Michelle Goldhahn at Prometric, the agency that administers the ARE, to see if they would allow New Jersey Professional Engineers to continue taking the 3.1 version of the ARE after June 2009. Prometric advised that they follow NCARB guidelines and cannot deviate from the ARE sections. Ms Schiripo then inquired if Prometric can make the vignettes from certain sections available for NJ Professional Engineers to take; again the answer was they follow NCARB guidelines and cannot deviate or alter the ARE. The Board determined that Messrs. DeMassi, Joshi and Zaccone will review the ARE information and will review each section of the ARE version 4.0 to determine how much of the sections are geared toward engineering and how much is geared toward site design and building design sections the New Jersey Professional Engineers would need to take of the ARE. VI NEW BUSINESS A Landscape Architect Examination and Evaluation Committee June 18, 2008 minutes ACTION: Mr. Zaccone motioned to accept / approve the Landscape Architect Examination and Evaluation Committee minutes. Mr. Horii seconded the motion. It passed unanimously B Interior Design Examination and Evaluation Committee 1 May 7, 2008 minutes ACTION: Mr. Zaccone motioned to accept the Interior Design Examination and Evaluation Committee minutes. Mr. Horii seconded the motion. It passed unanimously 2 June 4, 2008 minutes ACTION: Mr. Zaccone motioned to accept / approve the Interior Design Examination and Evaluation Committee minutes. Mr. Kniesler seconded the motion. It passed unanimously 3 Frances Maenza 7/24/08 Copy of a July 9th letter drafted by DAG Albertson and sent to Philip Maenza, attorney for Frances Maenza. Copies of the letters outlined in the July 9th letter are also attached for Board information. ACTION: DAG Albertson informed the Board that an appeal from Philip Maenza on behalf of his sister, Frances Maenza, of the Committee’s denial of her initial application due to her not meeting the educational requirement. Ms. Maenza requested the Committee to consider her application through the grandfather application. The Committee denied her request because she did not file the grandfather application prior to the April 28, 2007 deadline. C Correspondence 1 Copy of a letter dated June 30, 2008 from James L. Browning inquiring as to the statute of limitations of how long plans and specifications are to be kept as well as that statute of limitations on professional liability is attached for Board review. ACTION: The Board determined to send a letter advising that these issues are not covered in the Architect statute and regulations and that he should consult with his own attorney. 2 Copy of a memo dated July 21, 2008 from Arthur Russo, Executive Director, Board of Professional Engineers and Land Surveyors regarding establishing a special committee of the Joint Committee to prepare a response to the Jason Lusardi letter is attached for Board’s review. ACTION: Executive Director informed the Board that he received a request from the Board of Professional Engineers and Land surveyors to schedule a special meeting of the Joint Committee of Architects & Engineers to discuss the Lusardi matter. Upon speaking with the Chairman, Mark Roche, the meeting was scheduled for August 5, 2008 at 9:30am in the Union Room. An e-mail advising the members of the scheduled special meeting with agendas and minutes to follow. 3 Copy of Al Zaccone’s letter dated July 7, 2008 addressed to the Division of Law regarding the Lusardi matter is attached for Board’s information. ACTION: Duly noted. D Information 1 Copy of an e-mail dated July 21, 2008 from NCARB regarding NCARB’s ARE e-news is attached for the Board’s information. ACTION: Duly noted. 2 Copy of a NCARB News Clips dated July 21, 2008 announcing Architect Andrew W. Prescott, AIA was elected First Vice President of National Architect Council is attached for the Board’s information. ACTION: Duly noted. VII REVIEW OF APPLICATIONS A. IX EXECUTIVE SESSION At 10:45 am, Mr. Kniesler motioned to go into executive session for the purposes of conducting the inquiries scheduled for today. Mr. Horii seconded the motion.
