A meeting of the New Jersey State Board of Medical Examiners was held on Wednesday, January 14, 2009 at the Richard J. Hughes Justice Complex, 25 Market Street, 4th Floor Conference Center, Trenton, New Jersey. The meeting was called to order by President Paul C. Mendelowitz, M.D.

PRESENT

Board Members Cheema, Ciechanowski, Criscito, Criss, DeGregorio, Haddad, Lambert, Lomazow, Mendelowitz, Nussbaum, Paul, Scott, Stanley, Walsh, and Wheeler.

EXCUSED

Board Members Jordan, Salas-Lopez, Strand, and Weiss.

ALSO PRESENT

Deputy Attorneys General Levine, Warhaftig, Dick, Flanzman, Cordoma, Puteska, Ehrenkrantz, Gelber, Executive Director Roeder and Mary Lou Mottola, Executive Director of the Medical Practitioner Review Panel.

STATEMENT CONCERNING THE
ANNUAL NOTICE OF PUBLIC MEETINGS

The requirements of the "Open Public Meetings Act" have been satisfied by notice of this meeting given in the annual notice adopted by the New Jersey State Board of Medical Examiners on September 10, 2008 which was transmitted to the ATLANTIC CITY PRESS, STAR LEDGER, CAMDEN COURIER POST, ASBURY PARK PRESS, BERGEN RECORD and the TRENTON TIMES, all on the 1st day of October 2008.

ANNOUNCEMENTS

MINUTES THE BOARD, UPON MOTION MADE AND SECONDED, VOTED TO APPROVE THE DECEMBER 3, 2008 OPEN BOARD MINUTES.

NEW BUSINESS

1. DHSS - New Rules/Amendments
Birth Defects Registry

Attached was a proposal from the Department of Health and Senior Services concerning the Birth Defects Registry. Comments, if any, are due by January 19, 2009.

THE BOARD, UPON MOTION MADE AND SECONDED, VOTED NOT TO COMMENT ON THE PROPOSAL AT THIS TIME.

None.

INFORMATIONAL

PUBLIC COMMENT

Ms. Eileen Kean from the Medical Society of New Jersey asked whether the Executive Committee had reviewed the matter concerning the requirement to maintain medical malpractice insurance for those in the Active, Reduced fee licensure status ("Retired"). Executive Director Roeder informed Ms. Kean that a letter is being reviewed that is intended to be sent to all those that hold, or will eligible to hold, that status informing them of the requirements. He suggested that the licensee community would be pleased with the committee’s decision.
