I CALL TO ORDER

The regular monthly meeting of the Board of Cosmetology and Hairstyling was called to order at 9:30 a.m.

Roll Call:

Ms. Janice Alvarez, Mr. Ronald Jerome Brown, Mr. Jack A. Fornaro, Mr. Chris Jones, Mr. Joseph Santagata, Mr. Jerry Speziale, Mr. Jay A. Malanga, Executive Director, Mr. Patrick J. McNally, Assistant Executive Director, Ms. Barbara Ambroise, Program Development Assistant were present.

Also in Attendance:

Ms. Gracinda Almeida, Administrative Assistant, Ms. Marisol Rodrigues, Office Supervisor and the Board’s counsel.

II OPEN PUBLIC MEETINGS ACT

The Chair announced that the time, date and location of the meeting was listed in the Annual Notice Schedule. The Annual Notice Schedule was mailed to Ms. Nina Mitchell Wells, Secretary of State and the Newark Star-Ledger and Trentonian Newspapers on December 15, 2008 and was posted in the Office of the Board of Cosmetology and Hairstyling on December 15, 2008.

III APPROVAL OF MINUTES (OPEN & CLOSED)

Upon motion made by Mr. Chris Jones and seconded by Mr. Jerry Speziale, the Executive Director's report, Committee reports and Minutes of the regular monthly meeting held January 13, 2009 are accepted as read. The motion passed unanimously.

IV PUBLIC PARTICIPATION SESSION

Mr. Raymond Testa, a co-author of the Ad Hoc Committee for Association of Cosmetology and Hairstyling Schools of NJ, was in attendance and greeted the Board. He restated the concerns submitted by the Ad Hoc Committee in response to the proposed re-adoption of the Board’s regulation including: N.J.A.C. 13:28-1.1(e)-application for teacher license-proof of work experience (minimum 30 hour a week); N.J.A.C. 13:28-1.3-temporary and student permits; N.J.A.C. 13:28-2.1-application for facility license; N.J.A.C. 13:28-2.1(iv)-physical requirements; N.J.A.C. 13:28-6.20-clinical uniform; N.J.A.C.13:28-6.21- leave of absence from school; N.J.A.C. 13:28-6.27(f); and N.J.A.C. 13:28-3.2- the cost of filtering water.

V EXECUTIVE DIRECTOR'S ANNOUNCEMENTS

Mr. Malanga distributed information on skin care programs to be conducted in April. He stated that one other issued for Board information is that the State of Indiana has gone from a paper certification with a raised seal to an electronically printed certification send directly to the Board office.

VI FOR BOARD CONSIDERATION

1. IMO Carmen M. Nunez application to restore cosmetologist-hairstylist license #WG01335 and her conviction of a criminal offense was presented to the Board for consideration.

In the Boards discussion on this matter, it was pointed out that Ms. Nunez presents no threat at this time.

Upon motion made by Mr. Chris Jones and seconded by Ms. Janice Alvarez, Ms. Nunez is allowed to renew her license provided she have no further contact with the criminal justice system. Mr. Jack Fornaro and Mr. Joseph Santagata abstained, but the motion passed.

2. Correspondence received from Ms. Maria Cabrera, 121 French Avenue, Westmont, New Jersey in connection with the outstanding penalty assessed against her in the amount of $100.00 for the alleged violation of N.J.S.A. 45:5B-5B-12(f) & N.J.A.C. 13:28-2.12(a)2 at Holiday Hair #65050, 300 South Lenola Road, Maple Shade, New Jersey on December 14, 2007 was presented to the Board for consideration. She has indicated that she would like to waive her right to a hearing but has furnished a written explanation for the Board to consider before rendering its final decision.

After careful consideration, upon motion made by Ms. Janice Alvarez and seconded by Mr. Jack Fornaro, the fine stands. The motion passed unanimously.

3. Correspondence received from Ms. Hilda Baena, 85 B Forest Drive, Springfield, New Jersey in connection with the outstanding penalty assessed against her in the amount of $100.00 for the alleged violation of N.J.S.A. 45:5B-5B-12(f) & N.J.A.C. 13:28-2.12(a)2 at Spirit Spa Of Oldwick LLC, 40 Main Street, Oldwick, New Jersey on October 17, 2007 was presented to the Board for consideration. She has indicated that she would like to waive her right to a hearing but has furnished a written explanation for the Board to consider before rendering its final decision.

After careful consideration, upon motion made by Mr. Jack Fornaro and seconded by Mr. Chris Jones, the fine stands. The motion passed unanimously.

4. Correspondence received from Ms. Jenny Nguyen, t/a Lucky Nails & Spa, 45 South New York Road, Galloway, New Jersey in connection with the outstanding penalty assessed against her in the amount of $1,400.00 for the alleged violations resulting out of an inspection of her shop on November 10, 2008 was presented to the Board for consideration. She has indicated that she would like to waive her right to a hearing but has furnished a written explanation for the Board to consider before rendering its final decision.

After careful consideration, upon motion made by Ms. Janice Alvarez and seconded by Mr. Jack Fornaro, the fine stands. The motion passed unanimously

5. Correspondence received from Mr. Barry Beck, President, t/a Bluemercury, Inc., 2801 Pacific Avenue, Atlantic City, New Jersey in connection with the outstanding penalty assessed against him in the amount of $550.00 for the alleged violations resulting out of an inspection of his shop on September 13, 2007 was presented to the Board for consideration. He has indicated that he would like to waive his right to a hearing but has furnished a written explanation for the Board to consider before rendering its final decision.

After careful consideration, upon motion made by Ms. Janice Alvarez and seconded by Mr. Jack Fornaro, the fine stands with a payment plan. The motion passed unanimously

6. Correspondence received from Ms. Bridget Damiano, Vice President, Capri Corporate Management, Inc., 615 Winters Avenue, Paramus, New Jersey 07652 in connection with her request to increase the Teacher Training Program to a 600 hour course for all five Capri Institute Schools was presented to the Board for consideration.

Upon motion made by Mr. Jerry Speziale and seconded by Mr. Jack Fornaro, the Board approves the increase of a Teacher Training Program to a 600 hours course for all five Capri Institute Schools. The motion passed unanimously.

7. Correspondence received from Ms. Carole W. Yates, Director, New York State Education Department, Albany, New York in connection with certification of transcripts of hours for students seeking to transfer into New Jersey was presented to the Board for information.

The Board acknowledged the information.

8. Disciplinary Matters Pending Conclusion by Default

The UPLs were issued and no written response from respondents have been received by the Board to date. These matters were subject to finalization 15 days after issuance. The Attorney General seeks to issue Final Decision and Default Order on UPL for each of the following: IMO

Upon motion made by Mr. Chris Jones and seconded by Ms. Janice Alvarez, the Board authorizes the issuance of Default letters as indicated above. The motion passed unanimously.
