I CALL TO ORDER

The regular monthly meeting of the Board of Cosmetology and Hairstyling was called to order at 9:30 a.m.

The Board recited the Pledge of Allegiance and had a moment of silence for the fallen soldiers and those serving our country.

Roll Call:

Ms. Janice Alvarez, Mr. Ronald Jerome Brown, Mr. Jack A. Fornaro, Mr. James J. Forte, Mr. Chris Jones, Mr. Joseph Santagata, Mr. Jerry Speziale, Mr. Jay A. Malanga, Executive Director, Mr. Patrick J. McNally, Assistant Executive Director and Ms. Barbara Ambroise, Program Development Assistant were present. Also in Attendance:

Ms. Gracinda Almeida, Administrative Assistant, Ms. Marisol Rodrigues, Office Supervisor, Ms. Yolanda Morales, Principal Clerk Transcriber and the Board’s counsel.

II OPEN PUBLIC MEETINGS ACT

The Chair announced that the time, date and location of the meeting was listed in the Annual Notice Schedule. The Annual Notice Schedule was mailed to Ms. Nina Mitchell Wells, Secretary of State and the Newark Star-Ledger and Trentonian Newspapers on December 15, 2008 and was posted in the Office of the Board of Cosmetology and Hairstyling on December 15, 2008.

III APPROVAL OF MINUTES (OPEN & CLOSED)

Upon motion made by Mr. Jerry Speziale and seconded by Ms. Janice Alvarez, the Executive Director's report, Committee reports and Minutes of the regular monthly meeting held May 12, 2009 are accepted as read. The motion passed unanimously.

IV PUBLIC PARTICIPATION SESSION

Ms. Darlene Fox of the Cosmetology Association was in attendance and greeted the Board

V EXECUTIVE DIRECTOR'S ANNOUNCEMENTS

Mr. Malanga distributed the information on the 90th National Convention, Institute and Trade Show of the National Beauty Culturist League, Inc. and an article growth in the industry.

VI FOR BOARD CONSIDERATION

1. IMO Salena A. Pratt in connection with her arrest and her desire to complete a term of training and eventually sit for examination was presented to the Board for consideration.

Mr. Jack Fornaro reqused himself.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Joseph Santagata , Ms. Pratt is allowed to sit for examination upon successful completion of training provided she have no further contact with the criminal justice system. The motion passed unanimously.

2. IMO Jeremy Di Muccio in connection with his arrest and his desire to complete a term of training and eventually sit for examination was presented to the Board for consideration.

Mr. Jack Fornaro recused himself.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Jerry Speziale, Mr. Di Muccio is allowed to sit for examination upon successful completion of training provided he have no further contact with the criminal justice system. The motion passed unanimously.

3. IMO Antoinne Chrisp in connection with his criminal offense and his desire to complete a term of training and eventually sit for examination was presented to the Board for consideration.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Joseph Santagata , the Board withheld decision on this matter pending an updated letter from Mr. Chrisp’s Parole officer. Mr. Christian Jones abstained. The motion passed.

4. Correspondence received from Ms. Nicole Shealey, t/a Nick’s One Stop Beauty Shop, 301A Evesham Avenue, West, Magnolia, New Jersey in connection with the outstanding penalty assessed against her in the amount of $250.00 for the alleged violation resulting out of an inspection of her shop on March 11, 2009 was presented to the Board for consideration. She indicated that she would like to waive her right to a hearing and furnished a written explanation for the Board to consider before rendering its final decision.

Upon motion made by Mr. Jack Fornaro and seconded by Mr. James Forte, the fine stands. The motion passed unanimously.

5. Correspondence received from Ms. Tina Israel, t/a Try Love’s Alterations Israel, 3110 Mount Ephraim Avenue, Haddon Township, New Jersey in connection with the outstanding penalty assessed against her in the amount of $250.00 for the alleged violation resulting out of an inspection of her shop on February 13, 2008 was presented to the Board for consideration. She indicated that she would like to waive her right to a hearing but furnished a written explanation for the Board to consider before rendering its final decision.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Jack Fornaro, the fine stands. The motion passed unanimously.

6. Correspondence received from Mr. Jack Sand, Franchise/General Manager, Cyberstyle, Inc., T/A Supercuts, 8 Dominion Drive, Marlton, New Jersey in connection with the outstanding penalty assessed against him in the amount of $550.00 for the alleged violations resulting out of an inspection of his shop on December 26, 2008 was presented to the Board for consideration. He indicated that he would like to waive his right to a hearing and furnished a written explanation for the Board to consider before rendering it final decision.

Upon motion made by Mr. Joseph Santagata and seconded by Mr. Jack Fornaro, the fine stands. The motion passed unanimously.

7. IMO Celeste Adamski in connection with her criminal offense and her desire to attend cosmetology and hairstyling school and eventually become licensed was presented to the Board for consideration.

Note: Ms. Adamski appeared before the Board for an investigative inquiry on May 12, 2009; but the Board withheld decision on this matter pending review of a psychological report.

Upon motion made by Mr. Christian Jones and seconded by Mr. James Forte, the Board went into Closed Session to seek advised of counsel. The motion passed unanimously.

Upon motion made by Mr. Jerry Speziale and seconded by Mr. Jack Fornaro, the Board returned to Open Session. The motion passed unanimously.

Upon motion made by Mr. Joseph Santagata and seconded by Mr. Christian Jones, Ms. Adamski is allowed to sit for examination upon successful completion of training provided she have no further contact with the criminal justice system. The motion passed unanimously.

8. IMO Juanita Days in connection with her criminal offense and her desire to renew cosmetologist-hairstylist license #WG41333 was presented to the Board for consideration.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Christian Jones, Ms. Days’ conviction does not bar her from reinstating her license provided she have no further contact with the criminal justice system. The motion passed unanimously.

9. IMO Mr. Curtis Mosley in connection with his criminal offense and his desire to renew cosmetologist-hairstylist license #WG20331 was presented to the Board for consideration.

Upon motion made by Mr. Chris Jones and seconded by Mr. Jerry Speziale, Mr. Mosley’s conviction does not bar him from reinstating his license provided he have no further contact with the criminal justice system. The motion passed unanimously.

10. IMO Jessica Solarski in connection with her criminal offense and her desire to renew cosmetologist-hairstylist license #WG50334 was presented to the Board for consideration.

Upon motion made by Mr. James Forte and seconded by Ms. Janice Alvarez, the Board withholds decision on this matter pending Ms. Solarski’s appearance at an investigative inquiry. The motion passed unanimously.

11. Finalization of Provisional Order of Denial (POD) IMO Sean P. Mullen was presented to the Board for consideration.

Mr. Chris Jones reqused himself.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Jack Fornaro, the matter was tabled for the July meeting. The motion passed unanimously.

12. An e-mail received from Mr. Robert N. Ridolfi, Esquire on behalf of his client, Angela Pantaleone, in connection with her application for reduction of space of V C Salon Spa, 2350 Route 33, Bldg. B, Robbinsville, New Jersey was presented to the Board for consideration.

Mr. Ridolfi was present with his client Ms. Pantaleone and the Mayor of Robbinsville.

Mr. Ridolfi greeted the Board and explained the situation to the Board. He stated that as Vanity Care Salon became a fully license spa and as it was opening, his client was approached by two doctors offering to sublease a portion of the salon as a medical spa. He instructed his client to apply to the Board to reduce the area of her salon. He assured the Board the two business were completely different entities and separate. There was no co-mingling of any sort. No sharing of waiting room or lavatory, separate entrances and signage. He provided the Board with a copy of the new floor plan and indicated that there were two doors that connected the salon and med spa and that it was for fire safety reasons. He stated that if possible, his client would also like to share a common coffee area for employees of the two businesses.

Upon motion made by Mr. Jerry Speziale and seconded by Mr. Jack Fornaro, the Board went into Executive Session. The motion passed unanimously.

Upon motion made by Mr. Jack Fornaro and seconded by Mr. James Forte, the Board returned to Open Session for more questioning. The motion passed unanimously.

Ms. Pantaleone stated that she was not doing any massaging any more, her salon would be strictly for manicures, pedicures etc..

The Board informed her that the shared area for employees to have coffee could not be done, that the doors that connected the spa and salon would have to be locked at all times.

Upon motion made by Mr. Christian Jones and seconded by Mr. Jerry Speziale, Ms. Pantaleone’s request to reduce her salon is approved with the stipulation that the two doors be locked at all times other than for emergency purposes, no co-mingling of any sort and the menu is to be modified to take out massage services. The motion passed unanimously.

13. The following Uniform Penalty Letters (UPLs) are recommended for administrative closure due to, including but not limited to, the age of the matter, incorrect address, no forwarding address for the business or licensee, and limited information on the licensee.

Upon motion made by Mr James Forte and seconded by Ms. Janice Alvarez, the above listed matters are to be administratively closed. The motion passed unanimously.

14. Ms. Jenny Lee Schmidt, Mr. Michael J. Schmidt and Ms. Donna Joy, Supervising Teacher appeared before the Board in connection with their application for initial school licensure of Jersey Shore Beauty Academy-a Paul Mitchell Partner School, LLC, 712 Route 70, Brick, New Jersey 08723.

Mr. Michael J. Schmidt, Ms. Jenny Lee Schmidt and Ms. Donna Joy greeted the Board.

Ms. Janice Alvarez and the Board asked questions of Ms. Joy, the supervising teacher and Ms. Jenny Schmidt.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. Christian Jones, the school application for Jersey Shore Beauty Academy-a Paul Mitchell Partner School, LLC is approved subject to a favorable final inspection. The motion passed unanimously.

COMMITTEE REPORTS

Examination & Sites:

Ms. Janice Alvarez reported that all committee work is up to date. She stated that they were waiting on a vendor for CBT testing.

Mr. Jay Malanga stated that they are waiting for treasury to make the decision.

Upon motion made by Ms. Janice Alvarez and seconded by Mr. James Forte, the Board allows the chair and/or vice chair to approve matters regarding CBT should any arise. The motion passed unanimously.

Education & New Studies:

Ms. Janice Alvarez reported that all committee work is up to date.

Violation:

Mr. Jerry Speziale reported that all committee work is up to date.

Regulatory:

Mr. Chris Jones reported that there was no business at hand.

The Board will appoint in September a regulation committee to address the following issues: separation of businesses within the existing licensed facility (including subleasing of space), Brazilian waxing, temporary teacher’s permit, barbering regulation and other health related issues.

School and Department of Education Liaison:

Ms. Janice Alvarez reported that all committee work is up to date.

Public Relations:

Mr. Jerry Speziale reported that all committee work is up to date..

Legislation:

Mr. Jack Fornaro reported that A3181 passed the Assembly and was scheduled to go before the appropriations committee on June 11.

X ADJOURNMENT

Upon motion made by Mr. James Forte and seconded by Mr. Jack Fornaro, the meeting was adjourned at 2:00 P.M.. The motion passed unanimously.
