The Board Minutes of July 2, 2008, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of August 6, 2008, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of July 2, 2008, was called to order at 9:00 A.M.
The following members were present:

Barbara A. Cook, Executive Director, was present from 9:00 A.M. until the close of the meeting.

Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting.

Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting.

Ginger R. Provost, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting.

Michelle Ditzhazy and Erik Ruben, Interns, Division of Law, were present.

Also in attendance was James Bibbo, Central Jersey Electrical League.

The Board saluted the Flag.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve (13) Initial Licenses effective July 2, 2008 to March 31, 2009.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve (8) Initial Business Permits effective July 2, 2008 to March 31, 2009.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve (5) Initial Business Permits Previously Expired effective July 2, 2008 to March 31, 2009. (#2 is being held in abeyance pending further review)

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve (4) Changes in Business Permits effective July 2, 2008 to March 31, 2009.

The Board elected a Chairman for the year July 2, 2008 to June 30, 2008, pursuant to N.J.S.A. 45:5A-5.

Mr. Richard T. Aicher, Jr. nominated Mr. Joseph P. Schooley, and the nomination was seconded by Mr. Constantinos Papademas.

Let the record reflect that Mr. Schooley has been elected Chairman for the Board from this date until the July 2009 meeting.

Mr. Robert A. McCullough nominated Barbara A. Cook Executive Secretary/Director, and the nomination was seconded by Mr. Joseph F. Cantalupo.

Barbara A. Cook was unanimously elected Executive Secretary/Director for the year 2008 to 2009.

Cashier’s check in the amount of $7,500.00 received from Michael Mandel, License #3894, as the first and final payment of a civil penalty in the amount of $7,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq.

The Board accepted the payment.

Three checks in amounts of $1,000.00, $1,000.00 and $500.00 received from Brian Fitzgerald, License #14611 (Suspended), as the first and final payment of a civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:45C-1.2 & 3.

The Board accepted the payment.

Postal Money Order in the amount of $500.00 received from Tony D. Clark, Unlicensed, as the first installment of a civil penalty in the amount of $1,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1. The balance due is $500.00.

The Board accepted the payment.

Postal Money Order in the amount of $100.00 received from James Gandy, Unlicensed, as the fourteenth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-3.3 and N.J.S.A. 45:5A-9. Payments started May 25, 2007 and the balance due is $1,100.00.

The Board accepted the payment.

Letter received June 9, 2008, received from Fred R. Kisby, III, requesting a six-month continuance of business under Permit #3694 according to N.J.S.A. 45:5A-14. The licensee, Frederick R. Kisby, Jr., died on October 10, 2007.

Mr. Kisby has requested to take the October 2008 examination.

Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Kisby advising him that pursuant to N.J.S.A. 45:5A-14 the firm of Fred R. Kisby, Jr. Electrical Contractor has been granted a six-month continuance of business under permit #3694. Mr. Kisby will be advised that only one extension will be granted as the firm has been operating since October 2007.

The Board reviewed an application for reinstatement received from Chester A. Brzostek as he failed to renew his License #7403 for the 2000 to 2003; 2003 to 2006 and 2006 to 2009 triennial renewal periods.

Motion made by Mr. Robert A. McCullough and seconded by Mr. James H. Flaherty, and unanimously passed, that a letter be sent to Mr. Brzostek advising him that in order to regain his License #7403 he must take and pass the written examination pursuant to the Uniform Enforcement Act which requires that five years after a license has expired a licensee is not permitted to renew his/her license without first taking the qualifying examination.

Letter dated May 20, 2008, received from Brian Fitzgerald requesting reinstatement of his License #14611 which he failed to renew for the 2003 to 2006 and 2006 to 2009 triennial renewal periods.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Joseph F. Cantalupo, and unanimously passed, that Mr. Fitzgerald’s License #14611 be reinstated with the payment of the proper fees and proof of having attended 34 hours of Continuing Education Courses for the renewal period of 2003 to 2006 and 2006 to 2009.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Kennie Fried, Warshauer Electric Supply.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that one (1) new course, and instructor, is approved as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Wayne Martiak.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that the courses entitled "Basic Photovoltaic Systems" and "Advanced Photovoltaic Systems" are approved. Mr. Martiak will be advised that the course entitled "Electrical Contractor Exam Preparation" is denied as examination preparation courses are for those individuals who are not yet licensed.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from John Gearhart, Square D.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that one (1) new course, and instructor, is approved as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Robert C. Needs, Delaware Technical & Community College.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that seven (7) new courses, and instructors, are approved as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Colin Hylton.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that thirteen (13) new courses, and instructors, are approved as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Lawrence Kosden.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that Mr. Kosden’s request is denied at this time. Mr. Kosden did not provide detailed course descriptions, only an overview of each topic. Therefore, Mr. Kosden will be requested to provide more detailed course descriptions for each subject matter.

Mr. Robert A. McCullough recused himself from the discussion and the motion as he is listed as one of the instructors.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Suzanne M. Borek.

Motion made by Mr. Constantinos Papademas and seconded by Mr. James H. Flaherty, and unanimously passed, to approve Ms. Borek’s request that she be allowed to transfer previously approved courses under her sponsorship to the sponsorship of the South Jersey Chapter IAEI. The Board also approved Ms. Borek’s request to be added as an instructor to previously approved courses under the sponsorship of the South Jersey Chapter IAEI.

Cease and desist agreement was received from Robert Sereika, Hackettstown, New Jersey, 07840.

The Board accepted the signed cease and desist agreement.

Barbara A. Cook, Executive Director, advised the Board that she has not received a response to the Board’s inquiry about raising the gas allowance for travel. Mrs. Cook advised that she will follow-up on this request.

Mrs. Cook also stated that she has been advised by the Division of Law that the two names reflected on the Board’s third quarter Fiscal Year 2008 bill were listed in error.

The Board reviewed applications for the written examination to be administered by Thompson Prometric. Twenty-one (21) applications were approved.

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
