PROFESSIONAL COUNSELOR EXAMINERS COMMITTEE I. CALL TO ORDER The scheduled meeting of the Committee was called to Order at 9:48 a.m by Committee Chair, J. Barry Mascari, at the State Office Building, located at 124 Halsey Street, 6th floor, Hunterdon Conference Room, Newark, New Jersey. II. ROLL CALL

APPROVAL OF PUBLIC MINUTES On a motion made by William Green, seconded by Barbara Maurer, the minutes of the June 5, 2008 public session meeting were approved as amended. IV. PUBLIC COMMENT Dr. Thomas Crawley, New Jersey Counseling Association representative attended the meeting to inform the Committee of the Association’s concerns and communications with legislators regarding the (Committee) staffing shortages, delay in the review of applications for licensure and the lack of a full compliment of appointed Committee members. Dr. Crawley informed the Committee that as of July 1, 2008, Jennifer Cooper has been elected to serve as New Jersey Counseling Association’s president. V. EXECUTIVE REPORT The Committee was informed that Daniel Foster has been named Executive Administrator for the Department of Law and Public Safety. He fills the position left vacant by Kimberley Ricketts. David Suchzman, Esq. has been confirmed by the Senate and has assumed the responsibilities in his role as Director of the Division of Consumer Affairs. VI. LEGISLATIVE/REGULATORY N.J.A.C. 13:34-10 through 30: Regulation Sunset The Committee continues to review draft regulations. The Regulations Committee will further the work and report to the full Committee on September 12. VII. CORRESPONDENCE Susan Mock, LPC The Committee reviewed the July 8, 2008 faxed letter from Susan Mock regarding the impact of the February 8, 2008 filed Consent Order. The Committee determined to respond stating that the settlement offer in the matter advised her that the Consent Order is a public order. Ms. Mock will also be advised that she may want to consult with legal counsel in this matter. VIII. NBCC MATTERS The Committee accepted the Spring 2008 National Certified Counselor newsletter, as informational. IX. NJCA MATTERS In the discussion of the article, "Distance Counseling" included in the The American Association of State Counseling Board’s newsletter, The Liaison, the Committee will suggest that (1)distance counseling require an initial face-to-face meeting and (2) The counselor providing the service must hold a clinical license. X. FILED CONSENT ORDERS E. Malcolm Quigley, LPC, LMFT The June 20, 2008 filed Consent Order in the matter of E. Malcolm Quigley was presented to the Committee and accepted as informational. The licensee was reprimanded and assessed civil penalties for supervising and permitting an unlicensed person to perform counseling services in his private practice. XI. NEXT MEETING The next meeting of the Committee is rescheduled for September 12, 2008.
October 2, 2008 XII. EXECUTIVE SESSION On a motion by William Green, seconded by Barbara Mauer, the Committee moved to Executive Session at 10:07 to discuss pending disciplinary matters. XIII.
