In accordance with Chapter 231 of P.L. 1975, more commonly referred to as the Sunshine Law, adequate notice of this meeting was provided by mailing on November 30, 2007. A schedule of all 2008 Regular Open Committee Meetings of the Massage, Bodywork and Somatic Therapy Examining Committee to be held during 2008 was provided to the Office of the Secretary of State, Star Ledger, Trenton-Times, The New York Times, Camden Courier Post, The Press of Atlantic City and The Philadelphia Inquirer. The schedule has also been posted on the bulletin board at the New Jersey State Board of Nursing Office.

OLD BUSINESS:

February 7, 2008, response letter from Frank Pileggi, PhD, Director at Lourdes Wellness Center to Margaret C. Howard, RN, Field Representative seeking verification of eligibility for the New Jersey State certification for all graduates of Our Lady of Lourdes Institute of Wholistic Studies.

AFTER DISCUSSION, THE COMMITTEE UPON A MOTION MADE BY DEBORAH OVERHOLT AND DULY SECONDED BY ALAN G. VONDERAHE, VOTED TO SEND A RESPONSE LETTER TO FRANK PILEGGI WITH THE AMENDMENTS DISCUSSED AND INVITE DR. PILEGGI TO APPEAR FOR THE MAY 28, 2008, COMMITTEE MEETING. THE MOTION CARRIED.

Review of Legislative Bill 4455 signed into law.

Charles Manning, Regulatory Analyst, appeared for discussion and questions from the Committee concerning the Legislative Bill 4455 recently signed into law by the Governor on January 13, 2008.

OPEN FORUM

Ms. Cynthia Sinicropi-Balena thanked the Committee for its hard work on the process for the Massage Bodywork and Somatic Therapy certification.

New Wave Myotherapy Academy - Hearing for March 26, 2008 Committee Meeting.

AFTER DISCUSSION, THE COMMITTEE UPON A MOTION MADE BY DEBORAH OVERHOLT AND DULY SECONDED BY ALAN G. VONDERAHE, VOTED TO SCHEDULE NEW WAVE MYOTHERAPY ACADEMY TO APPEAR BEFORE THE COMMITTEE TO DISCUSS ITS PROGRAM AND PROVIDE SPECIFIC RECORDS OF FOUR APPLICANTS FOR MARCH 26, 2008 COMMITTEE MEETING WITH A COURT REPORTER. THE MOTION CARRIED.

AFTER DISCUSSION, THE COMMITTEE UPON A MOTION MADE BY DEBORAH OVERHOLT AND DULY SECONDED BY ALAN G. VONDERAHE, VOTED TO GO INTO EXECUTIVE SESSION FOR DISCUSSION AND ADVICE FROM COUNSEL ON MATTERS UNDER INVESTIGATION. THE MOTION CARRIED.

A motion was made by Deborah Overholt and duly seconded by Alan G. Vonderahe to adjourn the Massage, Bodywork and Somatic Therapy Examining Committee Meeting. Whereupon the meeting was adjourned at 1:25 p.m. The next Massage, Bodywork and Somatic Therapy Examining Committee Meeting will be held on March 26, 2008, 9:00 a.m., in the Sussex Conference Room, 6th Floor.
