Petitioner: Kathleen K. Mairella, P.T., M.A., President, American Physical Therapy Association of New Jersey. Take notice that on October 28, 2003, Kathleen K. Mairella requested that the State Board of Chiropractic Examiners (the Board) delete N.J.A.C. 13:44E- 2.12 in its entirety. The petitioner argues that the regulation was promulgated for the purpose of describing the responsibilities of licensees when "providing physician direction for the initiation of physical therapy treatment by a physical therapist" as required by the statute governing the licensing of physical therapists and that a recent change in that law as a result of enactment of P.L. 2003, c.18 removed this requirement. Therefore, according to the petitioner, the rule should be deleted since no physician direction is required by statute. In accordance with N.J.A.C. 1:30-4.2, the Board shall subsequently mail to the petitioner and file with the Office of Administrative Law a notice of action on the Petition.
