On
January 23, 1982, Michael Joseph Balsamo was arrested at
the Sands Hotel/Casino and on March 9, 1982, at the Golden
Nugget Hotel/Casino while attempting to use a cheating device
known as a "yo-yo" while operating a slot machine.
He was indicted by the State Grand Jury on two counts of
possession of a cheating device in violation of N.J.S.A.
5:12-114(c) and two counts of unlawful use of cheating device
in violation of N.J.S.A. 5:12-114(b)(2). On January 9, 1984,
he pled guilty to two counts of unlawful use of cheating
device. The two counts dealing with possession of a cheating
device were dismissed as a result of a plea bargain. The
respondent signed a waiver from consenting to his being
placed on the exclusion list without the benefit of a hearing.
Since he was already serving time for similar offenses in
Nevada, he was sentenced to prison concurrent with the time
he was incarcerated in Nevada. |
