Proposal
Summary:
The proposal would repeal the current
rules of Practice and Procedure of the
New
Jersey Division on Civil Rights, and
propose new rules governing this area.
The Division conducted a comprehensive
review of its Rules of Practice and Procedure
and determined that the existing rules
were in many cases difficult to follow
and somewhat outdated. The proposed new
rules would reorganize the existing rules
to make them easier to follow and update
them to reflect the current practices
of the agency. Other changes in the rules
are proposed to allow the Division to
more efficiently process cases before
the agency. Further changes are proposed
concerning the processing of housing discrimination
cases in order for the Division to achieve
certification as a substantially equivalent
agency by the federal Department of Housing
and Urban Development, which would permit
the Division to enter into a work-sharing
agreement with HUD. The proposed repeal
and new rules appear in the April 18,
2005 edition of the New Jersey Register.
