Proposal Summary:
The New Jersey Division on Civil
Rights proposes to readopt with amendments
its rules pertaining to Housing for Older
Persons. The Law Against Discrimination
prohibits housing discrimination based
on familial status, but provides that
this prohibition does not apply to housing
for older persons.
The rules proposed for readoption clarify
the types of housing for older persons
that automatically qualify for this exemption.
Certain amendments to the existing rules
are proposed in order for the Division
to achieve certification as a substantially
equivalent agency by the federal Department
of Housing and Urban Development, which
would permit the Division to enter into
a work-sharing agreement with HUD. The
proposed readoption with amendments appears
in the May 16, 2005 edition of the New
Jersey Register.
