POLICY STATEMENT.

 

The Division of Veterans Healthcare Services, under the direction of the New Jersey Department of Military and Veterans Affairs, shall establish a clear set of written guidelines which shall serve to inform residents and/or responsible representatives of the resident’s individual rights, and all regulations or rules governing resident conduct and responsibilities, as a condition of continued stay at a New Jersey Veterans Memorial Homes (VMHs).

 

PURPOSE.

 

This handbook shall serve to assist veteran home residents in their daily living activities, and to ensure residents are informed before or at the time of admission, and periodically thereafter, of their rights and those rules and regulations that govern their conduct and responsibilities during their stay in a New Jersey Veterans Memorial Home.  The procedure shall be available in book format and distributed for easy reference.

 

PROCEDURE.

 

A.     New Jersey Veterans Memorial Homes

 

  1. The New Jersey Veterans Memorial Homes will ensure veteran home residents are made aware of and become familiar with the basic criteria required of residents in their daily living activities, and of the obligations of all veteran home residents to abide by and comply with the rules and regulations as a condition of continued residence at the facility.

 

  1. A Residents’ Handbook shall be distributed to all veteran home residents at the time of admission.  A signed acknowledgement of receipt of the Residents’ Handbook will be kept on file.

 

B.     Department of Social Services

 

1.   The VMH Department of Social Services will assist residents and families with their transition from community to facility living.  Social Services will ensure residents are informed at the time of application or at the time of admission, and periodically thereafter, of their rights, and of those rules and regulations that they are required to abide by and comply with as a condition of continued residence at the facility.

 

 


INTRODUCTION LETTER.

 

Welcome to the New Jersey Veterans Memorial Home. We are happy to have you as part of our extended “family,” and we want you to know that all our staff members will strive to do everything possible to make this new living situation as pleasant as possible for you in this, your new Home.

 

This Residents’ Handbook was developed to make the transition to your new Home easier.  In any situation where many people live together under one roof, certain rules and regulations need to be established so that everyone understands what they can and cannot do.  In this way, we hope to ensure that life moves along smoothly and efficiently for everyone.

 

This Residents’ Handbook contains basic criteria to assist you in your daily living activities, as well as the rules and regulations that we all must follow.  It also contains a section on “Residents’ Rights,” rights to which you are entitled.  It is important to understand that it is the obligation of all Veterans Home Residents to abide by and comply with these rules and regulations as a condition of continued residence at the facility.  Violations and/or failure to comply with the conditions set forth may result in discharge proceedings.

 

If you wish to discuss any of these rules or regulations, please feel free to make an appointment with the Social Worker on your unit.

 

Our mission is to continue to improve the quality of life for all Veteran Home Residents within the Home.  We invite you to participate with us in achieving this mission.  We have a dedicated team of health care providers whose job is to care for you. We invite you to participate in the many full and varied activities that our staff provides, and we welcome your input and suggestions for new activities or events.

A.      Visiting Regulations

 

1.         Visiting hours are daily from 8 AM to 8 PM.

 

2.         Visitors are expected to abide by the following:

 

a.         The Chief Executive Officer or designee must approve visiting during off hours.

 

b.         Children under the age of 12 must be accompanied by an adult when visiting, and are permitted in the residents’ rooms with permission of the Supervisor of Nursing Services or designee.

 

c.         Respect the rights and privacy of other residents.

 

d.         Respect the property of the State of New Jersey and the property of other residents.  Weapons or any other type of instruments that may cause injury or damage are not permitted on state property.

 

e.         Avoid contact with all unsupervised animals on the grounds, such as cats, dogs, birds, squirrels, etc.

 

f.          Feeding of these animals is not recommended.

 

g.         Only residents are permitted to smoke in designated smoking areas.

 

B.      Identification

 

1.       Residents are required to have a current photograph placed in their medical record file.  All residents are encouraged to wear a designated form of identification.

 

2.         Visitors are required to obtain a visitors’ pass upon entrance.

 

C.      Social Conduct

 

1.         Residents shall conduct themselves in a quiet, orderly and courteous manner when dealing with employees, visitors, guests, volunteers, and others.

 

2.         Residents shall refrain from the use of profanity, vulgarity, immorality, physical altercation, stealing, and defiance of the rules and regulations.  Failure to do so may subject the resident to discharge.

 

3.         Residents shall refrain from displaying pornographic materials in any format, such as printed material or via Internet surfing.  The Chief Executive Officer or designee reserves the right to make the determination regarding the removal of any pornography.

 

4.         Residents shall be involved in the assessment and care planning process, including the discussion of diagnosis, treatment options, risks, and prognosis.  These discussions will be presented in language that the resident can be expected to understand. The resident will be allowed to make choices based upon the information provided.

 

5.         Residents receiving prescribed medications are to be available to the nurse at the designated times for medication administration.  Residents are to check with the nurse regarding their prescribed medication and treatment times.

 

6.         Residents shall have the right to share a room with their spouse providing both spouses consent to the arrangement.  Married couples that express their desire to share a room shall be granted preference, based upon availability.  Medical need shall also be granted preferential consideration.

 

7.         Residents are encouraged to discuss any personal concerns with their social worker.

 

8.         Residents shall refrain from undue noise or disturbances, which may be an annoyance to others.

 

9.         Residents with a significant hearing loss are required to purchase and use an earphone.  If the television is not equipped with an earphone jack, the resident will be required to purchase a television with adaptable earphones.

 

10.       Residents shall not possess alcohol, alcohol products, or controlled substances on state property without the specific order of a physician.

 

11.       Residents shall not request that visitors, employees, volunteers, or other residents purchase alcohol, alcohol products, or controlled substances for them.

 

12.       Residents who return to the facility in a state of intoxication may warrant discharge.

 

13.       Residents shall conduct themselves in an orderly and responsible manner when away from the facility and shall adhere to the rules and restrictions set forth for the activity.  Violations may warrant exclusion from activities.

 

14.       Residents approved for participation in an activity are requested to ensure that their personal appearance be neat, clean, shaven, and well groomed.

 

15.       Residents shall not possess any weapons on state property; this includes knives, firearms, fireworks or any other type of instrument that may cause injury or damage to persons and property.  Any violation of the above may result in discharge.

 

D.      Sanitary Standards

 

1.         All residents are expected to be neat, clean, groomed, and maintain good personal hygiene.

 

2.         Residents are not to discard personal toilet articles such as razor blades.  These items are to be given to nursing personnel for proper disposal in an appropriate disposal container for sharp objects.

 

3.         All residents are encouraged to bathe or shower at intervals that ensure good hygiene practices, but in any event, no less than two times per week.

 

4.         Clothing is not provided by the facility.  Residents are expected to be dressed in clean, dry, proper fitting, and seasonal clothing.  Storage for clothing is limited; therefore, provisions must be made to ensure adequate clothing is available for each season.

 

5.         All residents are to maintain their living area in a manner that does not restrict or impede egress in any way.  Areas are subject to inspection by facility representative.  If needed, arrangements shall be made to have areas cleaned.

 

6.         Residents are provided with basic room furnishings by the facility (i.e., one bed, one nightstand, one chair, one closet, and one over-bed table).  These furnishings are not to be removed or defaced.  Additional furnishings or equipment are not permitted without the prior approval of the Chief Executive Officer or designee.

 

7.         Residents are to permit the furnishings and room contents to be inspected upon notification, and in the presence of the resident.  During inspections or pest control activities, all resident-secured areas are to be unlocked.

8.         Residents are to exercise care in the use of wheelchairs, walkers, canes, or crutches, so as not to mar facility property or create harm or injury to self or others.

 

9.         Residents are to maintain food items such as cookies, candy, nuts, etc., in sealed containers with secure covers.

 

10.       Residents are not permitted to have perishable food stored in their rooms.

 

11.       Residents are not permitted to have alcohol, food, or any item that may cause a health or safety problem to themselves or others.  The Chief Executive Officer or designee has the right to remove such items.

 

12.       Residents are to turn off all utilities when not in use.

 

13.       Residents are to use appropriate trash receptacles and ashtrays for garbage and cigarette butts.  Trash is not to be thrown on the floor.

 

14.       Residents are to refrain from spitting on the floors and grounds adjacent to the buildings.  Residents are to use the appropriate facilities for elimination, to include spitting.

 

NOTE:

Residents are responsible for the cost of any property damage caused by abuse or misuse.  Further, residents shall not procure any facility property such as towels, washcloths, dishes, flatware, etc., for personal use, nor store such items in their rooms.

 

E.      Meals

 

1.         Breakfast, Lunch, Dinner, and Snacks are served at designated times.

 

2.         All diets are prescribed by physicians and nutritionally assessed by a dietitian.  Residents are encouraged to adhere to the prescribed diet.

 

3.         Nursing Service must be notified of ALL FOOD brought in for residents prior to the food being given to the resident.

 

4.         Concerns regarding meals should be communicated to your physician, dietitian, nurse, or Resident Advisory Council representative.

 

5.         Food and tableware are not to be removed from the dining areas.

 

6.         Appropriate attire is to be worn in all dining areas.

 

7.         If you plan to be absent for any meal(s), your nurse must be notified.

 

F.       Laundry

 

Laundry service is available through the facility as follows:

 

1.         The facility has entered into various contracts by which personal clothing will be laundered.  The price is based on weight or piece, as applicable.

 

2.         Residents may select to enter into their own contracts; however, laundry must be done twice weekly.

 

3.         Residents may select to do their own laundry using facility machines.  A designated time shall be arranged through the Housekeeping/Laundry Department.

 

4.         The facility will launder, at no cost to the resident, all facility linen such as towels, sheets, etc.

 

5.         All complaints with regard to laundry must be addressed to the Housekeeping/Laundry Department.

G.      Safety

 

1.         Residents shall not tamper or interfere with boilers, thermostat climate controls, or building equipment.

 

2.         Residents shall not interfere with medical equipment.

 

3.         Residents are not permitted to have electrical appliances without a safety inspection conducted by the Maintenance Department and prior approval of the Chief Executive Officer.

 

4.         No articles are to be stored on overhead lights and/or other electrical fixtures.

 

5.         Caution signs are to be observed and followed.

 

6.         Residents are encouraged not to keep or store medication or to use medication not prescribed by the assigned physician.  If ordered for self-administration by the physician, “self medication procedure” instructions will be provided and must be followed.

 

7.         Residents are not permitted cooking appliances in their rooms.

 

H.      Fire Safety

 

1.         The fire plan is posted in the hallways.  You are to observe the “YOU ARE HERE” notation and be aware of the nearest emergency “FIRE EXIT.”

 

2.         Always respond to any alarm or directions for evacuation given by a staff member.

 

3.         DO NOT USE ELEVATORS DURING A FIRE.

4.         DO NOT USE EMERGENCY FIRE EXITS FOR GENERAL EXIT PURPOSES.

 

5.         Flammable items such as newspapers, boxes, or combustible liquids are not to be stored in your room.

 

I.        Smoking Regulations

 

As smoking presents health, fire, and safety hazards, it is the department’s policy to discourage smoking and reinforce non-smoking practices among employees, visitors, and residents.

 

The following Smoking Policies have been established:

 

1.         Only the residents are permitted to smoke in the areas designated as “Smoking Permitted.”

 

2.         No smoking is permitted in residents’ rooms or hallways.

 

3.       Residents are recommended to use lighters that extinguish automatically.  Pipe smokers should use a pipe lighter.  Matches are discouraged for individual use.

 

4.         Dispose of all tobacco residues in the proper receptacles.

 

5.         All state facilities by law are smoke free; therefore, visitors and employees are not permitted to smoke within any state buildings.

 

J.       Facility Emergencies

 

1.         During periods of facility emergencies or adverse circumstances, families or representatives may be required to transfer residents elsewhere to provide for their necessary medical care.

2.         If families are not available, the facility will transfer residents to what is deemed the most appropriate setting by the facility administration and professional staff.  This will be at the expense of the residents or representative payors.

 

K.      Soliciting

 

No one is permitted to solicit or sell merchandise independent of the facility’s approval for any reason.

 

L.       Financial Transactions

 

1.         Upon admission, residents are required to establish their own personal accounts with the home’s Patient Account Representative.

 

2.         Residents may obtain money from their accounts through the Patient Account Representative.  IT IS STRONGLY RECOMMENDED THAT RESIDENTS DO NOT KEEP LARGE SUMS OF UNSECURED CASH AND/OR OTHER NEGOTIABLE INSTRUMENTS.

 

3.         Residents will receive a written statement describing the services provided by the nursing home and the related charges at the time of admission and whenever there are any changes.

 

4.         Those residents who expire or are discharged will be charged a maintenance fee for the actual days the resident was listed on the facility census.  If payment was made for the month prior to the resident’s demise or discharge, a prorated reimbursement will made to the estate or on the settlement day of discharge.

 

5.         Any resident whose facility or Medicare charges have not been paid and who has been duly warned, shall, at the discretion of the Chief Executive Officer, be discharged and not readmitted until payment is satisfied.

6.         Any resident who has not supplied requested financial documentation may be charged an estimated rate or discharged at the discretion of the Chief Executive Officer.

 

7.         Upon admission to the facility, a resident is required to sign a direct deposit banking form for the facility.  Mandatory direct deposit will only be initiated after non-payment of charges and the resident being duly warned.

 

8.         Residents or the representative payers will receive at least quarterly, itemized, written accounts of their funds that are deposited with the facility Patient Account Representative.  This record will show the balance in the account at the beginning and end of the accounting period, as well as the total of all deposits and withdrawals.

 

9.         All physician services will be billed to resident’s health insurance provider. Therefore all physician, medical, and other related service expenses provided by or through the facility are the direct responsibility of the resident or representative payor.

 

10.       Residents are encouraged not to lend money to or borrow money from other residents. Employees are prohibited from borrowing or lending money to residents.

 

11.       Employees are not permitted to handle financial transactions for residents, except for Activity Department personnel or other authorized personnel.

 

12.       Residents should report to the administration any request by employees, visitors, or volunteers for payment for services rendered.  TIPS OR GRATUITIES TO FACILITY EMPLOYEES and VOLUNTEERS ARE NOT PERMITTED.

 

13.       Residents or the representative payers are responsible for payment of services.  This includes, but is not limited to:

 

a.         Transportation

b.         Physician services

c.         Hospitalization

d.         Specialized services, programs, or treatments

e.         Adaptive equipment

f.          Diagnostic services

g.         Outside services as requested by the resident

h.         Deductible fees not covered by medical insurances

i.          Any non-payment of debts incurred by a resident, including health care costs

j.          Personal purchases

k.         Payment for pharmaceuticals to reimburse Medicaid as required

l.          Medical appointments and related services requiring HMO referrals

m.        Barber and/or Beautician Services

 

14.       Falsification or withholding of income information by the resident or the representative payor may require the resident to pay the actual cost of services and/or be discharged from the facility.

 

15.       Residents or representative payors who are delinquent in payment for care and maintenance costs will be notified of this delinquency.  Ninety days beyond the date an account is deemed uncollectible, the action may be processed for collections, or resident may be discharged.

 

16.       The facility assumes no responsibility for damages or loss of monies, valuables, or personal property which is not secured by the Patient Account Representative, other than to take reasonable care to safeguard the property of those residents who are deemed incompetent.

 

M.      Transportation Services

 

1.         Residents may arrange for transportation at their own expense.  If additional information is needed, please contact your social worker.

 

2.         Ambulance and taxi services are available at the resident’s expense.

 

3.         Residents residing in a long-term healthcare setting are not permitted to have, store, or maintain personal vehicles on state property, unless they reside in specifically designated independent living wings.

 

N.      Personal Medical Care

 

1.         Residents may arrange for their own medical care at their own expense.

 

2.         If private physician care is received, the resident or the resident’s physician must provide the Medical Director with copies of all treatment results and medications prescribed in accordance with regulations.  This information will be entered into your medical record.

 

O.      Overnight Furlough/Pass

 

Residents requesting overnight passes or time away from the facility are to discuss this matter with the Head Nurse at least 72 hours prior to the furlough or pass date.

 

P.      Advance Directives

 

It is recommended that all residents of the New Jersey Veterans Memorial Home have an Advance Directive for healthcare and financial matters at the time of admission.  Sample forms are available through the Social Service Department at each facility.

 

Q.      Last Will and Testament

 

1.         Residents who have a Last Will and Testament should provide the Social Service Department with a copy.

 

2.         At the time of death, the resident’s estate will be released only with a surrogate’s order.

 

3.         The facility is to be advised of the funeral arrangements.  Social Services shall be advised of any changes to these arrangements.

 

R.      Discharge

 

1.         Admission to the facility is voluntary.  As a resident, you have the right to leave the facility at any time with proper notification of the Medical, Nursing, Social Service, and Administrative Departments.

 

2.         Residents choosing to leave the facility against medical advice do so at their own risk.

 

3.         Residents adjudicated as mentally incompetent may not leave the facility without approval of the legal guardian, notification of the Chief Executive Officer, physician, social worker, business office, and the family.

 

4.         A resident may be discharged for medical or therapeutic reasons as determined by the Interdisciplinary Care Team acting in accordance with New Jersey Department of Health and Senior Services regulations.

 

5.         A resident may be discharged from the facility at the determination of the health care providers/professionals upon the resident’s health being improved sufficiently so that there is no longer a need for the services provided by the facility.

 

6.         A resident may be discharged from the facility for failure to comply with the rules and regulations.

 

7.         Residents who are discharged from the facility for disciplinary reasons may not be re-admitted.

 

8.         Residents discharged at their own request may be considered for re-admission after a period of six (6) months.  This re-admission will be processed as a new application.

 

9.         Residents may be discharged or have other sanctions implemented for non-payment of fees in situations not prohibited by law.

 

10.       At the time of discharge, prepaid care and maintenance fees shall be rebated based upon prorating of days.

 

S.      Residents’ Rights

 

(New Jersey Department of Health and Senior Services “Standards for Licensure of Long-term Care Facilities,” Subchapter 4, Mandatory Resident Rights; Revised; July 27, 2005).

 

1.         Each resident shall be entitled to the following rights:

 

a.         To retain the services of a physician or advanced practice nurse the resident chooses, at the resident’s own expense or through a health care plan.

 

b.         To have a physician or advance practice nurse explain to the resident, in language that the resident understands, his or her complete medical condition, the recommended treatment, and the expected results of the treatment, except when the physician deems it medically inadvisable to give such information to the resident and records the reason for such decision in the resident’s medical record, and provides an explanation to his or her next of kin or guardian.

 

c.         To participate, to the fullest extent that the resident is able, in planning his or her own medical treatment and care.

 

d.         To refuse medication and treatment after the resident has been informed, in language that the resident understands, of the possible consequences of this decision.  The resident may also refuse to participate in experimental research, including the investigation of new drugs and medical devices.  The resident shall be included in experimental research only when he or she gives informed, written consent to such participation.

 

e.         To be free from physical and mental abuse and/or neglect.

 

f.          To be free from chemical and physical restraints, unless they are authorized by a physician or advanced practice nurse for a limited period of time to protect the resident or others from injury.  Under no circumstances shall the resident be confined in a locked room or restrained for punishment, for the convenience of the nursing home staff, or with the use of excessive drug dosages.

 

g.         To manage his or her own finances or to have the responsibility delegated to a family member, an assigned guardian, the nursing facility administrator, or some other individual with power of attorney.  The resident’s authorization must be in writing and must be witnessed in writing.

 

h.         To receive a written statement or admission agreement describing the services provided by the nursing home and the related charges.  Such statement or admission agreement must be in compliance with all applicable State and Federal laws.  This statement or agreement must also include the nursing facility’s policies for payment of fees, deposits, and refunds.  The resident must receive this statement or agreement prior to or at the time of admission, and afterward whenever there are any changes.

 

i.          To receive a quarterly written account of all resident’s funds and itemized property that are deposited with the facility for the resident’s use and safekeeping, and of all financial transactions with the resident, next of kin or guardian.  This record shall also show the amount of property in the account at the beginning and end of the accounting period, as well as a list of all deposits and withdrawals, substantiated by receipts given to the resident or his or her guardian.

 

j.          To have daily access during specified hours to the money and property that the resident has deposited with the nursing facility.  The resident also may delegate, in writing, this right of access to his or her representative.

 

k.         To live in safe, decent, and clean conditions in a nursing facility that does not admit more residents than it can safely accommodate while providing adequate nursing care.

 

l.          To be treated with courtesy, consideration, and respect for the resident’s dignity and individuality.

 

m.        To receive notice of an intended transfer from one room to another within the facility or a change in roommate, including a right to an informal hearing with the administrator prior to the transfer, as well as a written statement of the reasons for such transfer.  The nursing home shall not move the resident to a different bed or room in the facility if the relocation is arbitrary or capricious.  A transfer would not be considered arbitrary and capricious if a facility can document a clinical necessity for relocating the resident, such as a need for isolation or to address behavior management problems, or there is a hardship to an applicant for admission through a delay caused by inefficient distribution of beds by gender.

 

n.         To wear his or her own clothes unless this would be unsafe or impractical.  All clothes provided by the nursing facility shall fit in a way that is not demeaning to the resident.

 

o.         To keep and use his or her personal property, unless this would be unsafe, impractical, or an infringement on the rights of other residents.  The nursing facility must take precautions to ensure that the resident’s personal possessions are secure from theft, loss, and misplacement.

 

p.         To have physical privacy.  The resident must be allowed, for example, to maintain the privacy of his or her body during medical treatment and personal hygiene activities, such as bathing and using the toilet, unless the resident needs assistance for his or her own safety.

 

q.         To have reasonable opportunities for private and intimate physical and social interaction with other people, including arrangements for privacy when the resident’s spouse visits.  If the resident and his or her spouse are both residents of the same nursing facility, they shall be given the opportunity to share a room, unless this is medically inadvisable, and documented in their records by a physician or advanced practice nurse.

 

r.          To confidential treatment of information about the resident.  Information in the resident’s records shall not be released to anyone outside the nursing facility without the resident’s approval, unless the resident transfers to another health care facility, or unless the release of the information is required by law, a third-party payment contract, or the New Jersey Department of Health and Senior Services.

 

s.         To receive and send mail in unopened envelopes unless the resident requests otherwise.  The resident also has a right to request and receive assistance in reading and writing correspondence within 24 hours of receipt (exception: weekends and holidays), unless it is medically contraindicated and documented in the record by a physician or advanced practice nurse.

 

t.          To have unaccompanied access to a telephone at a reasonable hour to conduct private conversations, and, if technically feasible, to have a private telephone in his or her living quarters at the resident’s own expense.

 

u.         To stay out of bed as long as the resident desires and to be awakened for routine daily care no more than two hours before breakfast is served, unless a physician or advanced practice nurse recommends otherwise and specifies the reasons in the resident’s medical record.

 

v.         To receive assistance in awakening, getting dressed, and participating in the facility’s activities, unless a physician or advanced practice nurse specifies reason in the resident’s medical record.

 

w.        To meet with any visitors of the resident’s choice between 8:00 A.M. and 8:00 P.M. daily.  If the resident is critically ill, he or she may receive visits at any time from next of kin or a guardian, unless a physician or advanced practice nurse documents that this would be harmful to the resident’s health.

 

x.         To take part in nursing facility activities, and to meet with and participate in the activities of any social, religious, and community groups, as long as these activities do not disrupt the lives of other residents.

 

y.         To leave the nursing facility during the day with the approval of a physician or advanced practice nurse and with the resident’s whereabouts noted on a sign-out record.  Arrangements may also be made with the nursing facility for an absence overnight or longer.

 

z.         To refuse to perform services for the nursing facility.

 

aa.       To request visits at any time by representatives of the religion of the resident’s choice and, upon the resident’s request, to attend outside religious services at his or her own expense.  No religious beliefs or practices shall be imposed on any resident.

 

bb.       To participate in meals, recreation, and social activities without being subjected to discrimination based on age, race, religion, sex, nationality or disability.  The resident’s participation may be restricted or prohibited only upon the written recommendation of his or her physician or advanced practice nurse.

 

cc.       To organize and participate in a Resident Council that presents residents’ concerns to the administrator of the facility.  A resident’s family has the right to meet in the facility with the families of other residents in the facility.

 

dd.       To discharge himself or herself from the nursing facility by presenting a release signed by the resident.  If the resident is an adjudicated mental incompetent, his or her next of kin or guardian must sign the release.

 

ee.       To be transferred or discharged only for one or more of the following reasons, with the reason for the transfer, or discharge recorded in the resident’s medical record:

 

i.                     In an emergency, with notification of the resident’s physician or advanced practice nurse and next of kin or guardian;

 

ii.                   For medical reasons or to protect the resident’s welfare or the welfare of others;

 

iii.                  To comply with clearly expressed and documented resident choice or in conformance with the New Jersey Advance Directives for Health Care Act, as specified in N.J.A.C. 8:39-9.6(d); or

 

iv.                 For non-payment of fees, in situations not prohibited by law.

 

ff.         To receive written notice at least 30 days in advance when the nursing home requests the resident’s transfer or discharge, except in an emergency.  Written notice shall include the name, address, and telephone number of the New Jersey Office of the Ombudsman for the Institutionalized Elderly and shall also be provided to the resident’s next of kin or guardian 30 days in advance.

 

gg.       To be given a written statement of all resident rights, as well as any additional regulations established by the nursing facility involving resident rights and responsibilities.  The nursing facility shall require each resident or his or her guardian to sign a copy of this document.  In addition, a copy must be posted in a conspicuous, public place in the nursing facility.  Copies shall also be given to resident’s next of kin and distributed to staff members.  The nursing facility is responsible for developing and implementing policies to protect residents’ rights.

 

hh.       To retain and exercise all the constitutional, civil, and legal rights to which the resident is entitled by law.  The nursing facility must encourage and help each resident to exercise these rights.

 

ii.          To voice complaints without being threatened or punished.  Each resident is entitled to complain and present his or her grievances to the nursing facility administrator and staff, to government agencies, and to anyone else without fear or interference, discharge or reprisal.  The nursing facility is required to provide each resident and his or her next of kin or guardian with the names, addresses, and telephone numbers of the government agencies to which a resident can complain and ask questions, including the New Jersey Department of Health and Senior Services, and the Office of the Ombudsman for the Institutionalized Elderly.  These names, addresses, and telephone numbers shall also be posted in a conspicuous place near every public telephone and on all public bulletin boards in the nursing facility.

 

jj.                   Each resident, resident’s next of kin, and resident’s guardians shall be informed of the resident rights enumerated in this subchapter and each shall be explained to him or her.  None of these rights shall be abridged or violated by the facility or any of its staff.
