ACCEPTANCE OF GIFTS, GRATUITIES OR ENTERTAINMENT

 

POLICY STATEMENT:

It is the policy of the Department of Military and Veterans Affairs, Division of Veterans Health Care Services, that no employee shall accept from a veteran home resident, the family of a veteran home resident, or the representative of a veteran home resident, any gifts, gratuities, services, favors, or entertainment.

Employees shall not accept gifts, gratuities, services, favors, or entertainment from any persons, agencies, or firms who have done, are doing, or desire to promote business with the Division or the facility.

PURPOSE:

This policy/procedure shall serve to ensure that each of the New Jersey State Veterans Homes employ procedures that:

Prevent exploitation of the Veteran Home Resident by the employees of a New Jersey Veterans Memorial Home.

Promote and maintain the professional status of the employee.

Prevent allegations of exploitation made by a veteran home resident against an employee at the facility.

Prevent allegations that the discharge of official duties would be influenced by the acceptance of gifts, gratuities, services, favors, or entertainment.

Prevent allegations that any business transactions were entered into as a result of the acceptance of gifts, favors, gratuities, services, or entertainment.

DEFINITION:

GIFTS, GRATUITIES, SERVICES, FAVORS, AND ENTERTAINMENT includes, but are not limited to:

Any amount of money, goods, services, meals, entertainment or favors given to an individual employee in exchange for, or in appreciation for, services rendered.

Any amount of money, goods, services, meals, entertainment or favors rendered by the veteran home resident, family, or representative of the resident, if it is reasonably inferred that such was given for the purpose of influencing the discharge of official duties.

Any money, goods, services, meals, entertainment or favors of more than minimal value from persons, agencies, or firms who have done, are doing, or are interested in promoting a business transaction with the Division or the facility.

RESPONSIBILITIES:

It is the responsibility of all veteran home residents to report to the appointing authority, or designee, any actual or alleged acceptance of gifts, gratuities, services, favors, or
entertainment by an employee, when it could be reasonably inferred that the acceptance could influence the discharge of official duties.

A designee of the appointing authority shall investigate allegations of the above nature, and appropriate action shall be initiated upon substantiation.

EXCEPTIONS:

Small, non-monetary gifts, or acts of kindness and appreciation, such as candy, cake, cookies, or flowers are acceptable when given to a group of employees, e.g. Nursing Unit, Activities Department, etc.

Any items of minimal value given for advertisement purposes, such as ballpoint pens, calendars, etc. are acceptable.
