OVERTIME POLICY STATEMENT

It is the policy of the Department of Military and Veterans Affairs to adhere to the provisions of the Fair Labor Standards Act, Title 4A of the New Jersey Administrative Code, appropriate bargaining unit agreements, and directives issued by pertinent state agencies.

DEFINITION:

"Overtime" is defined as the time worked in excess of the regular workweek, or time worked on duly designated holidays.

"Cash Overtime Compensation" means payment at a rate of one and one-half times the hourly proration of the employee's base salary, or one and one-half times the employee's regular rate, as specified.

"Compensatory Time Off" is defined as the granting of time off in lieu of cash payment where permitted. Compensatory time off may be granted at the rate of one and one-half hours for each overtime hour worked, or hour for hour, in accordance with the Fair Labor Standards Act and Title 4A of the New Jersey Administrative Code.

Compensatory Time earned must be used within one work week or within two work weeks in NL status. Written request to accumulate earned compensatory time must be submitted to the Chief Executive Officer for approval/denial. No one can exceed 60 hours worth of compensatory time on the records.
