Proposed Rules – Remedial Driver Education (Driver Improvement Program and Probationary Driver Program)

The Motor Vehicle Commission (“Commission”) has proposed rules regarding the Commission’s Driver Improvement Program (“DIP”) and Probationary Driver Program (“PDP”). The rules that are the subject of this regulatory proposal pertain to the provision of remedial driver education courses pursuant to N.J.S.A. 39:5-30.2 and N.J.S.A. 39:3-13.4. The Commission currently provides remedial driver education under these statutes. Under these new rules, licensed New Jersey driving schools and Statewide safety organizations will be licensed to provide these courses.

The proposed new rules establish standards for: course content for DIP and PDP; provider and instructor eligibility, application requirements, license fee, license term, and administrative penalties and procedure; and operational requirements, including approved curriculum, approved classrooms, reporting, recordkeeping, privacy, advertising, and course tuition.
