Proposed Rule Readoption and Amendments - Driving School Rules The Motor Vehicle Commission has proposed readoption of, and amendments to, its Driving School regulations. The rules that are the subject of this regulatory proposal pertain to the licensing of driving schools and instructors, classroom facilities, and the administration of the State-approved written drivers’ and eye examinations. The Motor Vehicle Commission is proposing various changes to the regulations, including: eliminating the use of telephone answering services; including a requirement that restroom facilities be separated from living areas where a driving school business is conducted from a residence; limiting behind-the-wheel instruction to a two hour maximum within any 24-hour period; limiting the number of occupants permitted in a driving school vehicle during behind-the-wheel instruction; requiring inspection of driving school vehicles for compliance with existing safety requirements; requiring that an applicant seeking a license to instruct motorcycle operation have held a motorcycle license or endorsement for at least the past three consecutive years; requiring that a special learner’s permit have been issued to a student prior to the administration by the driving school of the State-approved drivers’ and eye examinations; and limiting the use of test questions and eye charts to the administration of such exams and for no other purpose. The Motor Vehicle Commission’s proposal was published in the December 7, 2009 issue of the New Jersey Register.
