Brownfield and Contaminated Site Remediation Program
The Brownfield and Contaminated Site Remediation Program's (BSCRP)goal is to restore key business sites to productive use through incentives that make redevelopment affordable.  The State's Brownfield and Contaminated Site Reimbursement Program allows developers (non-responsible parties) to recover up to 75% of their approved remediation costs as a result of applicable new taxes associated with the end-use of formerly contaminated properties.

Eight state taxes, including sales, business use and corporate taxes are eligible to be used to reimburse the developer for remediation costs. The program also allows for the reimbursement of sales taxes associated with the purchase of building materials.

The New Jersey Economic Development Authority (EDA) acts as the lead agency in the program, assisting interested parties in maximizing their use and potential for a site, aiding in ensuring that municipal support and statutory requirements are met and helping to provide access to support and information needed from other agencies. The Commerce Commission's Brownfield Coordinator will work closely with the developer and other state agencies to facilitate the application and project development process.

In partnership, EDA, the New Jersey Department of Environmental Protection and the Department of Treasury will work together to ensure only qualified developers obtain Redevelopment Agreements and a series of checks and balances are maintained as the project advances. 

The Department of Treasury tracks incoming eligible taxes and partners with Commerce in the evaluation and approval of all Brownfield agreements.  Treasury provides the collected taxes via reimbursement to the qualifying developer in accordance with the statutory guidelines.

The Department of Environmental Protection is the approving authority for all eligible costs that are submitted for reimbursement and are the issuers of the "No Further Action" (NFA) document, advising that the required remediation work has been performed in accordance with the Oversight Document outlining the method of cleanup.
