The NJ Explosives Act and Regulations provide for the protection of the public and property by establishing reasonable standards for the manufacture, sale, transportation, storage, use, possession, and disposition of explosives. The Explosives Act mandates that all manufacturing, storage, use, and sale of explosives must be registered and inspected. Also, before permits are issued for the use of explosives, the applicant must first pass a written test issued by the Department of Labor, Safety Compliance Unit. The NJ Fireworks Acts (Manufacture, Storage, and Transportation of Fireworks) are enforced to prevent the unlawful manufacture, sale, transportation, and/or use of dangerous fireworks. The Fireworks Acts mandate that inspections be conducted at facilities where fireworks are manufactured. Any person who purchases, uses, discharges, causes to be discharged, ignites, fires, or otherwise sets in action, or possesses any fireworks is guilty of a petty disorderly persons offense. The Sale and Public Display of Fireworks Act mandates that local municipalities acquire the necessary resolutions prior to allowing fireworks displays. The NJ High-Voltage Proximity Act and the NJ Regulations provide the precautions to be taken in the proximity of high-voltage lines for the prevention of accidents. Also, the High Voltage Proximity Act makes provisions for administration and enforcement by the Commissioner of Labor and prescribes penalties for violations. The NJ Mine Safety Act along with the NJ Pits and Quarries Regulations provide for the safety and health of workers and for the construction, operation, and maintenance of pits and quarries in the interest of the life, health, and safety of employees, as well as protection of property. The Mine Safety Act also provides for the development of safety educational programs. The Mine Safety Section receives a grant from the Mine Safety and Health Administration to administer training to employees of approximately 110 mines in the New Jersey. The department has developed training materials, methods, and modules; health and safety information has been compiled through contacts with various sources in the health and safety industries to provide Refresher, New Miner, MSHA Instructor, and haulage/contractor training. The NJ Model Rocketry Act and Regulations were written to substantially comply with the NFPA 1122 Code for Unmanned Rockets of the National Fire Protection Association. The rules and regulations include the procedures for obtaining storage permits, the procedures to be followed for use of model rockets, and the acceptable design, weight, and power of model rockets. The Department of Labor, Safety Compliance Unit maintains a current and complete list of all model rockets that have received certification, and this list is available to any person upon request. Occupational Safety Consultation Using the New Jersey Department of Labor and Workforce Development's free On-Site Consultation Service, employers can find out about potential hazards at their worksites, improve their occupational safety and health management systems, and even qualify for a one-year exemption from routine OSHA inspections (SHARP Program). This service uses well-trained safety and health professionals. Most consultations take place on-site, though limited services away from the worksite are available. Primarily targeted for smaller businesses (less than 250 employees), this safety and health consultation program is completely separate from the OSHA inspection effort. In addition, no citations are issued or penalties proposed. Under the Small Business Focus (SBF) initiative, companies with 50 or fewer employees will receive a special priority in scheduling consultations. Your name, your firm's name, and any information you provide about your workplace, plus any unsafe or unhealthful working conditions that the consultant uncovers, are kept confidential and will not be reported routinely to the OSHA enforcement staff. Your only obligation is to commit to correcting serious job safety and health hazards -- a commitment which you are expected to make prior to the actual visit and carry out in a timely manner. The Retail Gasoline Dispensing Safety Act and NJ Regulations mandate that no person dispense fuel at a gasoline station, unless that person is an attendant who has received fuel-dispensing instructions. The Retail Gasoline Dispensing Safety Act also ensures compliance with appropriate safety procedures, prohibition of the self-service of gasoline and other inflammable liquids, and installation of safety signs and equipment to enhance safety at retail gasoline stations. The Occupational Safety and Health Training Unit provides occupational safety and health training for both public and private sector employers and employees. All training is provided at no cost to the employer and is provided at the employer's facility. The training is delivered by experienced consultants who will customize courses for employers when needed. The safety and health training staff receive update training at least twice each year at the OSHA Institute in Chicago to keep abreast of changes in OSHA Standards. Public employers can request training by calling the Training Unit at 609-633-2587. Most of the training courses are based on OSHA Standards; others were developed from national consensus standards such as ANSI and NIOSH. Private sector training is limited to those employers who are recipients of a grant from the Workforce Development Partnership Program or who are doing skills upgrade training for their employees.
