ACUPUNCTURE EXAMINING BOARD
PUBLIC SESSION MINUTES
November 14, 2007

I ROLL CALL

PRESENT Mimi Vassilev-Baker, Henry McCann, Barbara Montana, Mark Matzen, Edith Lee, Roger Rossi,

CALL TO ORDER The regular monthly meeting of the Acupuncture Examining Board was called to order at 124 Halsey Street at 9:30 a.m., all members having been notified of the time, date and, place and materials pertinent hereto having been provided.

SUNSHINE LAW In compliance with Chapter 231 the Public Law of 1975, notice of this was sent to the Courier-Post and the Record.

II. MINUTES

A motion was made to approve the September 19, 2007 minutes with amendments. The motion was made by Dr. Barbara Montana and seconded by Mark Matzen. The motion carried by unanimous vote.

III. GUEST ACUPUNCTURIST

Mr. Walter Fricke, Academic Dean of the Eastern School of Acupuncture and Traditional Medicine, requests authorization for three guest acupuncturists at the school.

A motion was made by Edith Lee, to cite regulation N.J.A.C. 13:35-9.12 (a) and (b) to clarify that the guest acupuncturists meet criteria under the regulations. The board requests information as to whether the criteria was met at the next meeting. A motion was made by Edith Lee and and seconded by Dr. Barbara Montana. The motion was carried by unanimous vote.

IV. CORRESPONDENCE

1. Pacific College of Oriental Medicine sends additional information on BPS degree in Asian Holistic Health and Massage for Board consideration. Gina LePore addressed the board on BPS degree.

Regulations requires regional accreditation for school bachelor degree. The board stated that they stand by regulations and Ms. LePore’s discussion and materials will be taken as informational.

2. Kateri Hyung

Correspondence received from Ms. Hyung asking whether the acupuncture examination given in California is equivalent to NCCAOM. The Board states that there is no provision for reciprocity under regulations. Chair directs board office to send letter with copy of regulations to applicant.

Edith Lee made a motion to proceed to Executive Session, seconded by Roger Rossi, to consider and review advertisement, consumer complaints and other information received pursuant to the Board’s investigative authority in order to determine whether violations of law, including Board regulations, have occurred. The results of these deliberations will be made known when, and if, the Board chooses to issue a Uniform Penalty Letter, the action will be taken in Public Session immediately after the Executive Session.
