CALL TO ORDER

The regular monthly meeting of the Acupuncture Examining Board was called to order at 124 Halsey Street at 9:30 a.m., all members having been notified of the time, date and, place and materials pertinent hereto having been provided.

SUNSHINE LAW In compliance with Chapter 231 the Public Law of 1975, notice of this was sent to the Courier-Post and the Record.

II. MINUTES

A motion was made to approve January 31,2007 as amended by correcting spelling error on second line and deleting May 23 meeting date due to holiday. The motion was made by Henry McCann and seconded by Karen Wei-Ru Lin. The motion carried by unanimous vote.

III. ANNOUNCEMENTS

a. Executive Director Renee Clark assumes responsibility for the Board.

b. Renewals–Executive Director Clark discussed the new online renewal procedure, how licensees will be directed to renew online with credit cards although they may also request paper renewals via the license verification telephone number.

IV. PPOPOSED REGULATIONS

Executive Director Clark to discuss status of proposed regulations with regulatory analyst.

V. ACUPUNCTURE EXAMINATION

Two examiners are still needed for April 20 examination.

VI. CREDENTIAL ISSUES

a. Li Sheng Weng -- Board directs office to send him a letter stating that pursuant to regulations NJAC 13:35-9.3 and 13:35-9.13 the board is unable to approve his apprenticeship program because they are unable to evaluate his program. Motion was made by Mimi Vassilev-Baker seconded by Henry McCann. The motion carried by unanimous vote.

b. Alex Leyberman -- Board directs office to send him a letter indicating that they do not interpret the board baccalaureate requirement to include a B.P.S. in acupuncture. His application for licensure will be denied because he does not have the traditional, four year B.A. degree.

Board also directs office to send letter to all schools in New York State which offer the B.P.S./M.S. degree and indicate that, by regulation, the Board only accepts applicants which obtain the traditional four-year B.A. degree along with the three years of acupuncture training. Motion was made by Henry McCann seconded by Edith Lee. The motion carried by unanimous vote.

c. Yasha Yang -- Chair directs board office to send her a letter indicating that Executive Director Earle has already spoken to the board of Connecticut on her behalf and explained New Jersey’s position on tutorial programs, but this did not sway the opinion of the Connecticut board. Ms Yang is directed to contact NCCAOM or ACAOM or a Connecticut acupuncture association to see if they can help her with her problem.

d. Application for Physicians -- Board approved application for physicians to be placed on the website. Dr. Lin made motion to go into Executive Session for two investigative inquiries and to review Division of Law billing.

Edith Lee made a motion to proceed to Executive Session, seconded by Henry McCann, to consider and review advertisement, consumer complaints and other information received pursuant to the Board’s investigative authority in order to determine whether violations of law, including Board regulations, have occurred. The results of these deliberations will be made know when, and if, the Board chooses to issue a Uniform Penalty Letter, the action will be taken in Public Session immediately after the Executive Session.
