Administrative Law Judge Jeffery Gerson decided the matter of Kenneth Zahl, M.D - OAL Docket Number BDS 5123-06 (Zahl ll) with an Initial Decision forwarded to the parties on or about December 19, 2008. This matter has been set down for final decision making by the Board at 10 a.m. on February 11, 2009.

The Attorney General urges the Board to adopt ALJ Hurd’s Initial Decision in it’s entirety. The Attorney General further urges the Board to issue a Final Decision revoking Dr. Manzella’s license to practice medicine and surgery in the State of New Jersey and to assess all appropriate costs and penalties. This matter was adjourned from the January 14, 2009 Board meeting and is scheduled for February 11, 2009 at 11 a.m.

The Attorney General filed a Motion for Summary Decision and accompanying brief in support on or about December 30, 2008 in the above referenced matter. The Board also has received Respondent’s Answer in Opposition to the Motion filed on or about January 20, 2009.
This matter is scheduled to be considered by the Board at its February 11, 2009 meeting. Oral argument on the Motion for Summary Decision will begin at 1 p.m. or as soon thereafter as the matter be heard.

Dr. Azam’s case was heard by the Board on Wednesday January 14, 2009 on the Attorney General’s application for an Order to Show Cause seeking the temporary suspension of Dr. Azam’s license to practice medicine and surgery and for other such relief deemed appropriate. The Board declined to suspend Dr. Azam’s license and ruled that the doctor could continue to practice at Insights Behavioral Health LLC, subject to certain restrictions. Dr. Azam is now petitioning the Board with two additional proposals. The matter is scheduled to be heard on the papers on February 11, 2009.
