State Board of Medical Examiners A meeting of the New Jersey State Board of Medical Examiners was held on Wednesday, February 13, 2008 at the Richard J. Hughes Justice Complex, 25 Market Street, 4th Floor Conference Center, Trenton, New Jersey. The meeting was called to order by Dr. Criscito, President. PRESENT Board Members Cheema, Criscito, Criss, DeGregorio, Haddad, Jordan, Lambert, Mendelowitz, Nussbaum, Paul, Reichman, Scott, Stanley, Strand and Walsh. EXCUSED Board Members Clemency-Kohler, Ciechanowski, Lomazow, Salas-Lopez, Weiss, and Wheeler. ALSO PRESENT Assistant Attorney General Joyce, Deputy Attorneys General Dick, Jespersen, Krugman, Levine, and Warhaftig, Executive Director Roeder and Medical Education Director Blanks.
STATEMENT CONCERNING THE The requirements of the "Open Public Meetings Act" have been satisfied by notice of this meeting given in the annual notice adopted by the New Jersey State Board of Medical Examiners on September 26, 2007 which was transmitted to the ATLANTIC CITY PRESS, STAR LEDGER, CAMDEN COURIER POST, ASBURY PARK PRESS, BERGEN RECORD and the TRENTON TIMES, all on the 1st day of October 2007. ANNOUNCEMENTS None. REMINDER The Board meeting for next month will be held on March 19, 2008 - the third Wednesday of the month. LEGISLATION Senate 544 Pre-filed for introduction in the 2008 Session. Seeks to amend the Health Enterprise Zone law to allow municipalities more discretion in granting property tax exemption to medical offices. THE BOARD, UPON MOTION MADE AND SECONDED, VOTED TO SUPPORT THE PROPOSED LEGISLATION. OLD BUSINESS Nothing Scheduled. INFORMATIONAL AMENDMENTS TO N.J.A.C. 13:35-6.17(b)(4) - Emergency Rule It was reported that the Attorney General has reviewed this matter and while she believes that the focus of the rule is appropriate, she prefers that the issue be pursued with the normal rulemaking procedures. As there has not been any pattern of conduct by payers resulting in declinations of payments, it does not appear that the emergency rule is needed at this time. She also recognized that there appeared to be sufficient public interest on the matter that a public hearing on the proposal would be warranted. PUBLIC COMMENT
