818th BUSINESS MEETING OF THE BOARD OF EXAMINERS OF ELECTRICAL CONTRACTORS
(PUBLIC SESSION) - - - FEBRUARY 6, 2008

The Board Minutes of February 6, 2008, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of March 5, 2008, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of February 6, 2008, was called to order at 9:00 A.M.
The following members were present:

Mr. Joseph P. Schooley, Chairman, Mr. Joseph F. Cantalupo and Mr. Richard T. Aicher, Jr. were absent.

Barbara A. Cook, Executive Director, was present from 9:00 A.M. until the close of the meeting.

Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting.

Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting.

Ginger R. Provost, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting.

Also in attendance was James Bibbo, Central Jersey Electrical League.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that the Minutes of the Special Meeting held November 27, 2007, be approved with the following corrections:

Page 1, Paragraph 1

The Board Minutes of November 27, 2007, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of January 16, 2008, or soon thereafter as it may be considered.

Page 1, Paragraph 2 (the following paragraph is to be deleted)

Be it hereby resolved pursuant to N.J.S.A. 10:4-13 that the Board of Examiners of Electrical Contractors held a closed session regarding violations of the Law. It is expected that the discussions can be made public at the time action is taken.

Page 3, Paragraph 4

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that two (2) courses, and instructors, are approved as submitted. The previously approved courses are also approved.

Page 3, the following paragraph was inadvertently omitted

Motion made by Mr. Joseph F. Cantalupo and seconded by Mr. Robert A. McCullough, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve the Minutes of the 816th Meeting held December 12, 2007, with the following corrections:

Page 2, paragraph 9

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that eleven (11) new courses, and instructors, are approved as submitted.

Page 3, paragraph 9

The Board reviewed the Fiscal Year 2007 final budget report.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve the Minutes of the 817th Meeting held January 9, 2008, with the following addition to page 8 as per DAG Provost:

Charles Auriemma, License #10762, submitted a response to the Provisional Order of Discipline and answered the questions asked in the Demand for Statement under Oath which the Board reviewed.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (9) Initial Licenses effective February 6, 2008 to March 31, 2009.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (11) Initial Business Permits effective February 6, 2008 to March 31, 2009.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (4) Initial Business Permits Previously Expired effective February 6, 2008 to March 31, 2009.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve (12) Changes In Business Permits effective February 6, 2008 to March 31, 2009.

Check in the amount of $100.00 received from James H. Gandy, Unlicensed, as the eighth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $1,700.00.

The Board accepted the payment.

Postal Money Order in the amount of $300.00 received from Jack Giaimo, License #7375, as the ninth installment of a civil penalty in the amount of $3,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started April 16, 2007 and the balance due is $900.00.

The Board accepted the payment.

Two checks in the amounts of $250.00 each were received from Christopher Page, License #13710, as the sixth and seventh installments of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9; N.J.A.C. 13:31-3.3 (c) and N.J.S.A. 56:8-1 et seq. Payments started July 3, 2007 and the balance due is $1,000.00.

The Board accepted the payment.

Mr. Flaherty recused himself from the following motion as he is familiar with Germinski Electric.

Letter received January 23, 2008, from Robert A. Germinsky requesting reinstatement of his License #11861 which he failed to renew for the 2000 to 2003; 2003 to 2006 and 2006 to 2009 triennial renewal periods.

The Committee unanimously recommended that a letter be sent to Mr. Germinsky advising him that in order to regain his License #11861 he must take and pass the written examination pursuant to the Uniform Enforcement Act which requires that five years after a license has expired a licensee is not permitted to renew his/her license without first taking the qualifying examination.

The Committee also requested that Mr. Germinsky explain whether or not he was conducting business as an electrical contractor utilizing his Business Permit #11861 during the period of 2000 to 2004.

Letter dated January 23, 2008, received from John M. Miller requesting reinstatement of his License #13266 which he failed to renew for the 2000 to 2003; 2003 to 2006 and 2006 to 2009 triennial renewal periods.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Miller advising him that in order to regain his License #13266 he must take and pass the written examination pursuant to the Uniform Enforcement Act which requires that five years after a license has expired a licensee is not permitted to renew his/her license without first taking the qualifying examination.

Mr. Mitchell R. Malec recused himself from the following motion as he is an employee of the Department of Community Affairs.

Mr. Robert A. McCullough recused himself from the motion as he is listed as an instructor.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Susan McLaughlin, NJ Department of Community Affairs/Rutgers University.

The Committee unanimously recommended that five (5) new courses, and instructors, are approved as submitted.

The sub-committee reviewed additional information regarding Michael S. Hughes’ application for Continuing Education Course/Seminar approval. The sub-committee had requested that Mr. Hughes clarify if the course he was requesting approval of is one 24 hour course or three individual 8 hour courses. If Mr. Hughes seeks approval of three individual courses, he was to provide three separate course titles.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that three (3) new courses, and instructors, are approved as submitted.

The sub-committee reviewed additional information regarding Christina Bailey’s application for Continuing Education Course/Seminar approval. The Board requested that Ms. Bailey advise whether or not the seminar entitled "The 2008 National Electrical Code" is one 16 hour course or two eight hour courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that three (3) new courses, and instructors, are approved as submitted. The previously approved courses are also approved.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Joanna Osoliniec, Institute for Technical Advancement, LLC.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that four (4) new courses, and instructors, are approved as submitted.

Letter dated January 16, 2008, received from the Central Jersey Electrical League opposing Assembly Bill No. A4127. This bill provides that an applicant for a business permit meet certain minimum standards before being issued a permit.

DAG Provost stated that Assembly Bill No. A4127 has been re-filed as Assembly Bill No. A928.

Mr. McCullough stated that the Board had previously stated their position that they are not in support of this bill; however, the Board has not seen the re-filed version.

Mr. Bibbo stated that the Central Jersey Electrical League is vehemently opposed to this bill even though it impacts initial business permit holders only.

DAG Provost stated that the league can lobby the legislature and the members of the committee expressing their views. The Board is not permitted to become directly involved with legislation.

The Board reviewed the new percentage breakdown and number of questions for the electrical contractor’s examination which will start with the April 2008.

Motion made by Mr. Constantinos Papademas and seconded by Mr. Robert A. McCullough, and unanimously passed, to approve the new percentage breakdown and number of questions which is to start with the April 2008 examination.

The Home Improvement Registration Division requested that the Board review a copy of an advertisement to determine whether or not an electrical contractor’s license and business permit allows the advertiser to perform all of the work listed in the ad.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that all of the work listed in the advertisement comes under the jurisdiction of the licensed electrical contractor, who also holds a business permit, with the exception of Home Energy Audits.
