(PUBLIC SESSION) - - - MARCH 5, 2008

The Board Minutes of March 5, 2008, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of April 2, 2008, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of March 5, 2008, was called to order at 9:00 A.M.

Two Postal Money Orders in the amounts of $100.00 each were received from James H. Gandy, Unlicensed, as the ninth and tenth installments of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $1,500.00.

The Board accepted the payment.

Personal Money Order in the amount of $1,000.00 received from Charles Auriemma, License #10762, as the first and final payment of a civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:45C-1.2.

The Board accepted the payment.

Check in the amount of $250.00 received from Christopher Page, License #13710 as the eighth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9; N.J.A.C. 13:31-3.3 (c); and N.J.S.A. 56:8-1 et seq. Payments started July 3, 2007 and the balance due is $500.00.

The Board accepted the payment.

Debt Report received from the Division of Consumer Affairs reflecting Walter Robak, License #13717 (Expired) made a first and final payment towards a civil penalty the amount of $1,500.00 for violation of N.J.S.A. 45:1-21(e).

Check in the amount of $1,000.00 received from Michael Cafiero, Unlicensed, as the first and final payment towards a civil penalty in the amount of $1,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq.

The Board reviewed an Application for Reinstatement received from Frank A. Magliola, License #7207, as he failed to renew his License #7207 for the 2000 to 2003; 2003 to 2006 and 2006 to 2009 triennial renewal periods.

Mr. Magliola has provided copies of Continuing Education Certificates totaling 34 hours.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Magliola advising him that in order to regain his License #7207 he must take and pass the written examination pursuant to the Uniform Enforcement Act which requires that five years after a license has expired a licensee is not permitted to renew his/her license without first taking the qualifying examination.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Gary T. Sargent.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the previously approved courses be approved, including the change requested by Mr. Sargent.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Lawrence H. Kosden.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Kosden advising him that his request is being held in abeyance pending receipt of a more detailed course outline.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Gregory D. Peters, Northampton Community College.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Peters advising him that his request is denied at this time as the courses submitted do not meet the guidelines of continuing education. For example, Mr. Peters indicates that the courses include written quizzes and time for physical installation. Mr. Peters also indicates that the maximum number of participants is based on the class room size. Additionally, it appears that these courses are geared toward vocational teaching. Should Mr. Peters wish to resubmit his request, the Board would like to know if Floyd, who is listed as a preparer, is an instructor.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Ray Pietschmann.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that twelve (12) new courses, and instructors, are approved as submitted. The sub-committee requested that Mr. Pietschmann advise if the course entitled "Interpreting the 2008 NEC" is the required nine hours of code changes and one hour of laws, rules, and regulations. If so, Mr. Pietschmann will be requested to add one additional hour of code changes.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Michal Hofkin.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, that six (6) new courses, and instructors, are approved as submitted. The sub-committee requested that Mr. Hofkin advise if the course entitled "2008 Analysis of Changes and NJ Law" is the required nine hours of code changes and one hour of laws, rules, and regulations.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Anthony Urbanik. Mr. Urbanik contacted the Board office to advise that he would like to teach these courses for the 2006 to 2009 period for licensees who are renewing their license for the 2009 to 2012 period.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Urbanik advising him that his request is denied at this time as he did not provide a detailed course outline nor did he indicate which courses were to be combined. Additionally, Mr. Urbanik did not complete a Continuing Education application.

The sub-committee reviewed an application for Continuing Education Course/Seminar approved received from Marilyn Becker, Samson Electrical Supply Company, Inc.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that one (1) new course, and instructor, is approved. The previously approved courses are also approved.

Letter dated February 7, 2008, received from Joseph P. Kempker who is requesting to teach on-line continuing education courses.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Kempker advising him that his request is denied as web based courses do not meet the criteria of continuing education. The Board feels that it is very important to have a classroom environment.

Letter dated February 8, 2008, received from Ronald H. Pike, License #7528, requesting 10 continuing education credits towards his license renewal pursuant to N.J.A.C. 13:31-1.7.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Mr. Pike be granted 10 credits towards his 2009 to 2012 triennial renewal of his License #7528 pursuant to N.J.A.C. 13:31-1.7.

Letter dated February 22, 2008, received from Craig Danson, License #10403, requesting a waiver of the Continuing Education Courses for the renewal of his License #10403 which he failed to renew for the 2006 to 2009 period.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. James H. Flaherty, and unanimously passed, that a letter be sent to Mr. Danson advising him that he must attend 24 hours of Continuing Education Courses which were required for his 2006 to 2009 renewal period. Mr. Danson must also attend the nine hours of 2008 code changes and the one hour of laws, rules and regulations. Mr. Danson will not have to attend this ten hour course for his 2009 to 2012 triennial renewal period.

Mr. Danson will also be directed to return his pressure seal issued to North Star Electric.

The Board reviewed a memorandum dated February 21, 2008, received from Darlene Kane, Budget Officer, Division of Consumer Affairs, stating that for the second quarter of Fiscal Year 2008, the Electrical Board/Committee was directly billed for 94.6 hours of Deputy Attorney General/Paralegal services totaling $14,755.54.

As per the Board’s request, Maryann Sheehan, Regulatory Analyst, appeared before it at 10:00 A.M. to discuss amending N.J.A.C. 13:31-1.2(b2) Qualified Journeyman Electrician to parallel N.J.A.C. 13:31-2.1(a3) Qualifications of Applicant.

The qualifications of a Qualified Journeyman Electrician do not reflect that the applicant shall have hands on experience working under the National Electrical Code.

Therefore, a qualified journeyman electrician, who may or may not have experience working under the National Electrical Code, is supervising employees who are performing electrical work under the National Electrical Code.

Pursuant to N.J.A.C. 13:31-1.4( c ) "Supervision of Electrical Work" every ten employees who are performing electrical work at either one job site or who are performing electrical work at several jobs at different sites simultaneously shall be supervised, pursuant to N.J.A.C. 13:31-3.4(d), by a qualifying licensee or by a licensee or qualified journeyman electrician.

Mrs. Sheehan stated that she will draft language to indicate that a qualified journeyman electrician is a person who has acquired 8,000 hours of practical experience working with tools in the installation, alteration or repair of wiring for electric light, heat or power, which work shall have been done in compliance with the National Electrical Code. Mrs. Sheehan also stated that before the qualified journeyman electrician proposal is adopted she will attempt to make this change and will submit the language as a non-substantive change not requiring a re-proposal. Mrs. Sheehan also stated that the OAL has a standard to determine if a change is substantive and since we are not expanding the requirement we can say it was an omission as it is understood that a journeyman electrician must have experience working under the National Electrical Code. Mrs. Sheehan further stated that she will meet with the Board in April to discuss the comments received on the journeyman proposal.

A signed cease and desist agreement was received from Michael Cafiero, High Bar Harbor, New Jersey. A signed cease and desist was received from Mark Rufolo, Rufolo Construction, Belle Mead, New Jersey, agreeing to include language in his advertisement that all electrical work is "performed by licensed electrical contractors".

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Twenty (20) applications were approved.

Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
