EXECUTIVE DIRECTOR'S REPORT

Mr. Stellato announced that Mr. Mandeville will not be present today due to the passing of his father and that the Board have a moment of silence celebrating his life.

Mr. Stellato announce that in the absence of Mr. Mandeville, Mr. Eisenmenger will sit in for him.

Mr. Eisenmenger reported that the total number of complaints received in March were 9 and the total for the year are 27.

Mr. Eisenmenger reported that the next regular Board meeting has been scheduled for Tuesday, May 6, 2008 in the Hudson Conference Room, 6th floor.

Mr. Eisenmenger reported that 14 candidates were scheduled for the March 7th Jurisprudence Examination, 6 candidates passed, 7 failed and 1 was unable to attend, due to conflict with the new exam date.

The Committee reported that Section A) number 1) Exit Laughing was not approved, section F) Selected Independent Funeral Homes, number 1) 2008 Group Meeting were not approved, section G) National Funeral Directors & Morticians Association, Inc., number 2) House of Representatives /Stress Management was not approved, number 5) House of Representatives/Pandemic Influenza was approved for one (1) hour only, number 6) Presidential Roundtable was not approved. On motion made by Mr. Goldstein, seconded by Mr. Brown, the Board determined to accept the committee report as read. All voted in favor of the motion. Ms. Churchman opposed.

CORRESPONDENCE

NJ Cemetery Board Public Session Agenda for March 13, 2008 . This was for the Board?s information only.

Letter from Steven J. Ellmeyer requesting to have his internship extended. On motion made by Mr. Whiteley, seconded by Mr. Galante, the Board determined to grant a six (6) month extension to take and pass the Science portion of the National Board Examination and pass the practical examination. All voted in favor of the motion.

OPEN DISCIPLINARY MATTERS

#07-106 Edwards and Son Funeral Home, Bridgeton, Mgr., Dennis Bundy, paid $500.00 for violation of N.J.A.C.13:36-11.16 ( c) and N.J.S.A. 45:7-85 on February 28, 2008. This was for the Board?s information only. On motion made by Mr. Whiteley, seconded by Ms. Churchman, the Board determined to accept. All voted in favor of the motion.

#07-107 Edwards and Son Funeral Home, Salem, Mgr., Dennis Bundy, paid $500.00 for violation of N.J.A.C.13:36-11.16 ( c) and N.J.S.A. 45:7-85 on February 28, 2008. This was for the Board?s information only. On motion made by Mr. Whiteley, seconded by Ms. Churchman, the Board determined to accept. All voted in favor of the motion.

#07-130 Valley Memorial Funeral Home, Gillette, Mgr., Craig Tuma, paid the reduced penalty of $2,500.00 for violation N.J.S.A.45:7-47,45:7-61 (d) and N.J.A.C.13:36-4.1( b) on February 26, 2008. This was for the Board?s information only. On motion made by Mr. Whiteley, seconded by Ms. Churchman, the Board determined to accept. All voted in favor of the motion.

#07-138 Cremation Society of New Jersey, Clifton, Mgr., Thomas McNamara, submitted a letter for the Board?s consideration for violation N.J.A.C.13:36-1.9 (e) on March 6, 2008. On motion made by Mr. Whiteley, seconded by Ms. Churchman, the Board determine to uphold the uniform penalty letter. All voted in favor of the motion.

#08-23 Marrocco Memorial Chapel, Clifton, Mgr., James Marrocco, submitted a letter for the Board?s consideration for violation N.J.A.C.13:36-5.21 (a) and (b) on March 12, 2008. On motion made by Mr. Brown, seconded by Mr. Horwitz, the Board determined to uphold the uniform penalty letter. All voted in favor of the motion.

Licensee John Hughes Sr., submitted a response to the Provisional Order of Discipline, that was issued on February 21, 2008. On motion made by Mr. Goldstein, seconded by Mr. Whiteley, the Board directed DAG Krugman to issue a Final Order of Discipline indicating that he has complied with the Provisional Order of Discipline and to rescind the penalty of $2,500.00. All voted in favor of the motion.

Licensee Edward Manbeck Jr., was issued a Provisional Order of Discipline on February 21, 2008.On motion made by Mr. Lombardi, seconded by Mr. Brown, the board determined to move this matter to executive session for discussion. All voted in favor of the motion.

ITEMS FOR DISCUSSION

N.J.A.C.13:36-5.19 "The Use of Registered Mortuary in Organ and Tissue Recovery" was adopted on October 2, 2007 and filed without change on January 29, 2008. This was for the Board?s information only.

October 2, 2007 Open Agenda. The Board determined to hold this matter until the next monthly meeting.

PUBLIC COMMENT

None.

EXECUTIVE SESSION - 10:20 A.M. On motion made by Ms. Churchman, seconded by Mr. Whiteley, the Board determined to go into executive session to discuss consumer complaints and/or conduct investigative inquiries. The results of these deliberations will be made known when and if the Board determines to initiate disciplinary or other law enforcement action. If the Board determines to issue uniform penalty letters, that action will be taken in public session immediately after the executive session.
