APPROVAL OF MINUTES

New Jersey State Board of Mortuary Science Open Session Minutes for December 4, 2007

On motion made by Mr. Lombardi, seconded by Mr. Brown, the Board voted to approve the minutes as read. All voted in favor of the motion.

EXECUTIVE DIRECTOR'S REPORT

Mr. Mandeville reported that the total number of complaints received in December were 13 and the total for the year are 138.

Mr. Mandeville reported that the next regular Board meeting has been scheduled for Tuesday, February 5, 2008 in the Hudson Conference Room, 6th floor.

Mr. Mandeville reported that the majority of the funeral home renewed their registrations.

Mr. Mandeville reported that the Jurisprudence examination has been scheduled for February 22, 2008 at the Mercer County Community College.

The committee reported that section B) MKJ Marketing: Sandra Paive, was approved for ten (10) hours only, section E) The Conference: Lauren Harriman, was not approved, the Board is requesting additional information, section G) New Jersey Funeral Service Education Corp; Emily Moscetti, was approved for 16.5 hours only, section K) Aurora Casket Company: Ms. Brett Backman, was not approved, the Board is requesting additional information. On motion made by Mr. Galante seconded by Mr. Lombardi, the Board determined that the content of the courses of section L) SCI-Dignity University: Samira Neese, numbers 3, 9, 28 and 29 were not relevant to funeral directing. All voted in favor of the motion. The committee reported that section M) National Funeral Directors Association : Kathleen Walczak, all the courses that are 10 hours only were approved for 4 hours, and all courses that are 4 hours were approved for 2 hours only. On motion made by Mr. Brown, seconded by Mr. Galante, the Board determined to accept the committee report as read. All voted in favor of the motion.

OPEN DISCIPLINARY MATTERS

#07-84 Licensee Carmen Bastante, paid $1,500.00 for violation of N.J.A.C. 13:36-10.3 (a), N.J.S.A. 45:1-21(h) and (b) on November 26, 2007. This was for the Board's information only.

Licensee Walter Calhoun was served Final Order of Discipline on December 6, 2007. DAG Krugman reported to the Board that Mr. Calhoun suspension is now active effective January 8, 2008.

ITEMS FOR DISCUSSION

Assembly, No #3623 of the 212th Legislature which was introduced October 2006. This bill was passed by both houses of the legislature on January 7, 2008.

Senate Committee Substitute for Senate, No # 2387 of the 212th Legislature which was adopted on December 17, 2007. This bill was passed by both houses of the legislature on January 7, 2008.

PUBLIC COMMENT

Michael Mittenzwei, NJSFDA wanted to know if the Final Order of Discipline for Walter Calhoun can be published in the Forum.

EXECUTIVE SESSION - 10:25 A.M. On motion made by Ms. Churchman, seconded by Mr. Macysyn, the Board determined to go into Executive Session to discuss consumer complaints and/or conduct investigative inquiries. The results of these deliberations will be made known when and if the Board determines to initiate disciplinary or other law enforcement action. If the Board determines to issue uniform penalty letters, that action will be taken in public session immediately after the executive session.
