The Employment Counseling and Labor Section provides legal counseling and training for State Departments, colleges, commissions and agencies with regard to employment issues, focusing on issues of discrimination, CEPA (whistle blower law), First Amendment, Due Process, Americans with Disabilities Act and the Family and Medical Leave Act. The section assists agencies in proper enforcement of the State's Anti-Discrimination Policy, and responds to complaints in administrative forums that civil rights laws have been violated. The section also handles disciplinary hearings at the Civil Service Commission and labor arbitrations. In addition, the Section provides legal representation and counsel to the Department of Labor, which includes administrative enforcement of New Jersey labor laws. A substantial portion of the Section’s work involves handling appeals of client agency decisions. |
