Proposal Description:
The proposal is to repeal N.J.A.C.
13:71-29.2, the rule pertaining to inspection
of sulkies (harness horse race bikes), and
amend N.J.A.C. 13:71-29.3 to address certain
sulky-related issues. Specifically, the
amendments would require a sulky involved
in an accident to have a “do not use”
label affixed to it by the paddock judge
or his designee at the racetrack when the
incident occurs. The sulky then must be
inspected and repaired if necessary by its
manufacturer, who has the only authorization
to remove the “do not use” label
and determine the sulky safe again for competition.
The amendments would further place responsibility
for the operational fitness and maintenance
of sulkies with the driver/trainers who
have custody of them. The repeal of N.J.A.C.
13:71-29.2 is proposed because, as a practical
matter, it has proven to be unmanageable,
and is not enforced. The Racing Commission
believes the repeal of 13:71-29.2, and amendment
of 13:71-29.3 will create more manageable
rules when applied to the course of everyday
business, and will make New Jersey consistent
with neighboring states in the mid-Atlantic
region.
