- Attorney General Anne Milgram and Criminal
Justice Director Gregory A. Paw announced
that an Essex County woman pleaded guilty
today to submitting a false insurance claim
in an attempt to fraudulently collect more
than $12,000.
According
to Insurance Fraud Prosecutor Greta Gooden
Brown, Amy Brown Shane, 59, of Montclair,
pleaded guilty before Superior Court Judge
Edward M. Neafsey in Monmouth County to
a criminal accusation which charged her
with third-degree attempted theft by deception
and two counts of fourth-degree falsifying
or tampering with records.
At
the guilty plea hearing, Shane admitted
that she falsely claimed that she needed
to have veneers applied to eight of her
teeth as a result of a Nov. 28, 2006 automobile
accident.
Shane fraudulently submitted a $12,085 claim
to The Hartford Insurance Company following
the automobile accident. The false claim
stated that as a result of an automobile
accident, she required the application of
dental veneers to several of her teeth.
In fact, the application of veneers occurred
prior to the auto accident.
The
Hartford denied the claim and referred the
matter to the Office of Insurance Fraud
Prosecutor and assisted OIFP in the investigation.
Insurance Fraud Prosecutor Brown thanked
The Hartford for its assistance in this
matter.
Detective Michael Rasar, Civil Investigator
Robert Brescia, and Deputy Attorney General
Cheryl A. Maccaroni were assigned to the
investigation into this case. Maccaroni
represented the Office of Insurance Fraud
Prosecutor at the guilty plea hearing.
Shane
is scheduled to appear before Judge Neafsey
on June 20 to be sentenced. Third-degree
crimes carry a maximum sentence of five
years in state prison and a criminal fine
of $15,000, while fourth-degree crimes carry
a maximum sentence of 18 months in prison
and a fine of $10,000. Shane may also face
civil insurance fraud fines.
