Proposal
Description: The proposed amendment
to N.J.A.C.
13:70-6.53 would change eligibility and
registration requirements for resident and
non-resident mares. Specifically, the proposed
rule would require that, to be considered
a resident mare, the mare must reside in New
Jersey continuously from Nov. 1 of the year
prior to the foaling. If enacted, the proposed
Nov. 1 deadline would shorten the residency
requirement for mares by two months. The proposed
Nov. 1 deadline would also make New Jersey
less restrictive than Pennsylvania, which
currently imposes an Oct. 1 deadline. In addition,
it is anticipated that the Nov. 1 deadline
would eliminate problems associated with mares
located outside of New Jersey who could not
be shipped back to New Jersey by the current
deadline of Sept. 1 due to illness or safety
concerns associated with the transportation
of pregnant mares during hot summer months.
The proposed rule amendment also seeks to
change the time frame required for a mare
purchased at public auction to be considered
a New Jersey resident. Currently, a mare purchased
at auction must reside in New Jersey from
Aug. 17 of the year prior to foaling. The
proposed amendment would change the deadline
to Oct. 17.
