Description: The Office of Insurance Fraud
Prosecutor proposes to readopt with amendments
the rules at N.J.A.C.
13:88. The rules in this chapter were
to expire on May 3, 2009, but the filing of
this proposed readoption extended the expiration
date to Oct. 30, 2009. Subchapter 1 sets forth
the procedures to be used by OIFP for the
imposition of civil and administrative penalties
under the New Jersey Insurance Fraud Protection
Act. Subchapter 2 requires insurers writing
policies with at least $2 million in direct
premiums annually to report stolen vehicle
and automobile accident claims information
for use by OIFP in identifying and combating
insurance fraud. Subchapter 3 provides for
a statutorily authorized reward of up to $25,000
for a person who provides information leading
to the arrest, prosecution and conviction
of a person who has committed health care
claims fraud, insurance fraud or another crime
related to an insurance transaction. The rules
were reviewed and determined by OIFP to remain
necessary and reasonable for the purposes
for they were originally promulgated. The
amendments primarily involve corrections,
clarifications, technical changes and updates.
