Description: The Division of Criminal
Justice proposes to readopt with amendments
the Chemical Breath Testing Rules, N.J.A.C.
13:51. The Attorney General is authorized
under N.J.S.A. 39:4-50.3 to approve methods
of chemical breath testing and to certify
persons to perform these tests in enforcing
the state’s law against driving while
intoxicated. The rules adopted for that purpose
are scheduled to expire on Jan. 18, 2010.
The Division has reviewed the rules and determined
that, with the proposed amendments, they remain
necessary and reasonable for the purposes
for which they were originally promulgated.
The proposed amendments focus primarily on
clarifying the certification process for breath
test operators, including the duration of
a valid certification, and changing the periodic
inspection and calibration requirements for
the Alcotest instrument from one year to six
months.
