Description: The New Jersey Racing
Commission is proposing repeal of a rule
concerning representation by attorneys in
horse racing matters before the Racing Commission
or the Commission’s stewards, because
the current rule conflicts with New Jersey
Court Rule. The Racing Commission rule at
issue requires attorneys licensed in New
Jersey who wish to appear before the Commission
to apply for admission pro hac vice if they
do not maintain a bona fide legal office
in New Jersey. However, New Jersey Court
Rule R. 1:21-1 Who May Practice; Appear
in Court requires only that attorneys licensed
to practice in New Jersey maintain a bona
fide law office “in any State, United
States territory, Puerto Rico or the District
of Columbia.” As a result, the Racing
Commission rule must be amended or repealed
to achieve consistency with the Court Rule.
The Racing Commission has elected to propose
repeal of the rule.
