Proposal
Description: The New Jersey Racing
Commission is proposing a new rule, N.J.A.C.
13:70-1.42. The proposed rule sets forth
a procedure to allow for the continuation
of live horse racing and simulcasting in
the event that a State of Emergency is declared
due to failure by the State to enact a general
appropriation law by the deadline prescribed
by the New Jersey Constitution. Under the
proposed rule, should the Governor declare
a State of Emergency, and should employees
of the Racing Commission therefore be prevented
from performing their employment duties,
a holder of a permit to conduct a horse
race meeting may, under certain conditions,
continue to hold scheduled race and simulcast
operations for up to seven calendar days.
The proposed new rule would require any
permit holder wishing to be considered eligible
to continue to hold scheduled races and
simulcast operations during such a State
of Emergency to provide advance written
notice of its intentions to the Racing Commission
on or before June 1.
