- Attorney General Paula T. Dow and Acting
Insurance Fraud Prosecutor Ronald Chillemi
announced that a Union County man has been
indicted for allegedly attempting to obtain
approximately $14,000 from an insurance
company by falsely reporting his vehicle
stolen.
According
to Acting Insurance Fraud Prosecutor Chillemi,
Americo Delvalle, 35, of Linden, was charged
Friday (Sept. 23) with third-degree insurance
fraud, third-degree attempted theft by deception
and fourth-degree hindering one’s
own prosecution.
The Union County grand jury indictment alleges
that between Oct. 1 and Nov. 11, 2010, Delvalle
made false statements in support of an insurance
claim submitted to Allstate Insurance Company
that his 2009 Honda Civic had been stolen,
when he knew that the Civic had not been
stolen. It is alleged that Delvalle submitted
fraudulent documents and made recorded statements
in connection with the claim for reimbursement.
Delvalle allegedly attempted to obtain approximately
$14,000 from Allstate. The indictment further
alleges that Delvalle made a false police
report to the Linden Police Department in
order to hinder any prosecution against
him.
An
investigation by the Office of the Insurance
Fraud Prosecutor revealed that Delvalle
allegedly reported to the Linden Police
Department that he parked his Honda outside
a movie theater in Linden at 8:45 p.m. on
Oct. 1, 2010 and when he returned from the
theater at 11:30 p.m, the car had been stolen.
The investigation revealed that the Newark
Police found the vehicle abandoned and stripped
at 5:34 p.m., three hours before Delvalle
purportedly parked the vehicle in Linden.
Detective
Nicole Eiker and Deputy Attorney General
James A. Carey Jr. were assigned to the
investigation into this case. Carey presented
the case to the Union County grand jury.
Acting Insurance Fraud Prosecutor Chillemi
thanked Neil Hunt, SIU of the Allstate Insurance
Company, for his assistance in the investigation.
The
indictment is merely an accusation and the
defendant is presumed innocent until proven
guilty. Third-degree crimes carry a maximum
sentence of five years in state prison and
a criminal fine of $15,000, while fourth-degree
crimes carry a maximum sentence of 18 months
in state prison and a criminal fine of $10,000.
