Description: The Division of Criminal
Justice proposes to repeal the existing
rules at N.J.A.C. 13:75 concerning practice
and procedure before the New Jersey Victims
of Crime Compensation Office and adopt new
rules, which incorporate portions of the
existing rules. The Office conducted a comprehensive
review of its rules of practice and procedure
and determined that the existing rules in
many respects were difficult to follow and
not in full compliance with The Criminal
Injuries Compensation Act, N.J.S.A. 52:4B-1
et seq. The proposed amendments serve to,
among other things, resolve inconsistent
provisions resulting from various amendments;
reorganize provisions to better represent
a logical order based upon the major categories
of eligibility, filing and compensation;
address the current structure, which is
confusing because categories are intermingled,
making it difficult for victims, attorneys,
and providers to read and interpret; correct
ambiguous language to clarify the meaning;
include hearing procedures for the newly
created Review Board; and eliminate language
inconsistent with statutory provisions.
