TRENTON
- Attorney General Jeffrey S. Chiesa announced
that a Union County man has been sentenced
for attempting to obtain approximately $14,000
from an insurance company by falsely reporting
his vehicle stolen.
Americo
Delvalle, 36, of Linden, was sentenced on
Friday (May 4) to 270 days in county jail
as a condition of four years of probation
by Superior Court Judge Robert J. Mega in
Union County. Judge Mega ordered the Delvalle
to serve the jail time at the end of his
probationary term. Delvalle’s sentence
was based on his Jan. 17 guilty plea to
third-degree insurance fraud. The charge
was contained in a Union County grand jury
indictment returned on Sept. 23, 2011.
In
pleading guilty, Delvalle admitted that
between Oct. 1 and Nov. 11, 2010, he made
false statements in support of an insurance
claim submitted to Allstate Insurance Company
that his 2009 Honda Civic had been stolen,
when he knew that the Civic had not been
stolen. In an attempt to fraudulently collect
approximately $14,000 from Allstate, Delvalle
submitted fraudulent documents and made
recorded statements in connection with the
claim for reimbursement.
An
investigation by the Office of the Insurance
Fraud Prosecutor revealed that Delvalle
reported to the Linden Police Department
that he parked his Honda outside a movie
theater in Linden at 8:45 p.m. on Oct. 1,
2010 and when he returned from the theater
at 11:30 p.m, the car had been stolen. The
investigation revealed that the Newark Police
found the vehicle abandoned and stripped
at 5:34 p.m., three hours before Delvalle
purportedly parked the vehicle in Linden.
Deputy
Attorney General James A. Carey Jr. and
Detectives Nicole Eiker and Megan Flanagan
were assigned to the investigation. Carey
represented the Office of the Insurance
Fraud Prosecutor at the sentencing. Acting
Insurance Fraud Prosecutor Ronald Chillemi
thanked Neil Hunt of the SIU of the Allstate
Insurance Company, for his assistance in
the investigation.
