Proposal Description: The Division of Criminal Justice proposes to amend the State Body Armor Fund Program rules, N.J.A.C. 13:80A. These rules govern the grant program, which offers funding to local and certain State law enforcement and correctional agencies to offset the costs of purchasing body armor vests for eligible officers. The program is supported by the Body Armor Replacement Fund, a non-lapsing revolving fund financed through a $1 fee assessed on convictions for motor vehicle and traffic offenses and on forfeitures of bail. The Division of Criminal Justice proposes to amend the rules to authorize the Division Director to waive existing rules to allow greater flexibility in implementing the program when it serves the goal of officer safety and comports with the statutory policy set forth at N.J.S.A. 52:17B-4.4. The Division also proposes to add a requirement that agencies receiving funds have a written policy on mandatory wearing of body armor by uniformed patrol officers.
