Legislative History

Recording of marriages on the county level was first required in New Jersey by "An Act Concerning Marriages," passed by the General Assembly on 4 March 1795 (see Acts of the Nineteenth General Assembly..., chap. 526, pp. 1004-7). This legislation required every justice of the peace and ordained minister to file, for each marriage he performed, a certificate with the clerk of the county in which the marriage took place. The returns were then to be copied by the county clerk into a book kept solely for that purpose. This procedure remained the basic method of public recording of marriages in New Jersey until March 1848, when "An Act relating to the registry and returns of births, marriages, and deaths, in the State of New Jersey" was passed into law (see Acts of the Seventy-Second Legislature..., pp. 155-8). The 1848 legislation required municipal clerks to submit to the Secretary of State annual returns of vital records. It also stipulated that marriage records were to include certain additional vital information, such as the age, occupation, parents' names, and residence of each party, and the place of marriage.

Despite the initiation of state-level recording, direct filing of marriage records with the county continued for another thirty years. It was not until 5 April 1878 that further vital records legislation authorized marriage officiants to submit certificates to municipal clerks or assessors beginning on 1 June of that year (see Acts of the One Hundred and Second Legislature..., chap. 239, pp. 354-9). The municipal officers, in turn, were directed to file the records with the Secretary of State.

Content Note

This series contains Cumberland County marriages returns submitted by ministers, justices of the peace, and mayors. With the exception of one record by Jonathan Jarman dating from 1789 (but filed in 1823), the marriages span the period 1795-1878. Because the 1795 legislation required written consent of parents or guardians for marriages of minors (males under age 21 and females under age 18), a number of consent certificates are included with these documents. The law also required that filing was to be made within three months after the date of marriage if minors were involved, or within six months otherwise. This seems to have been routinely ignored, however, as returns listing marriages over periods of several years are common.

Because the records in this series are filed by officiant's name, locating an individual marriage return is best accomplished by first consulting the recorded version in Cumberland County marriage book A or B. These two volumes are available on microfilm in the Archives search room (Cumberland County film #1-1/Genealogical Society of Utah film #853,720); each includes an index to husbands' names. Once the officiant's name is known from the recorded version, this series can be checked for an original return.

Finally, it should be noted that Cumberland County's marriage records were published--though with numerous errors in transcription--by H. Stanley Craig as Cumberland County (New Jersey) Marriages (1932; reprinted 1978 by Gloucester County Historical Society). Unfortunately, Craig did not include officiants' names, which are needed in order to locate specific records in this series.
