Cannabis products sold at licensed Alternative Treatment Centers and at dispensaries in New Jersey are held to the highest quality standards to ensure the safety and health of patients and other consumers. Flower and manufactured products are subject to laboratory testing for biological and chemical contaminants, heavy metals, other foreign matter; and to determine potency and accuracy in labeling. In the event cannabis product is found to be defective, potentially unsafe, or otherwise out of compliance with testing or manufacturing standards, a product recall may be voluntarily initiated by an affected operator, or mandated by the NJ-CRC.
Concerns of contamination may be raised during laboratory testing, routine inspections of facilities, packaging, labeling, and products by NJ-CRC compliance officers, or in the event of an adverse event – such as illness or death of a consumer. After initial suspicion of contamination, products are withdrawn from commerce and put on hold. A recall will be issued if follow-up testing confirms the contamination or other concern.
Licensed and permitted cannabis operators are required to have standard operating procedures in place regarding how to manage incidents of contamination or suspected contamination. Those contingency plans should include factors that determine if/when a recall is needed, a mechanism for reaching customers and businesses that purchased the product(s) in question, for issuing refunds, and instructions for returning or destroying contaminated products.
Some of the reasons for which items may be recalled, include:
- Foreign matter, like insects, in product
- Mold on flower
- Improper packaging and/or labeling
- Falsified information on labeling
- Failure to maintain Metrc tracking
- Reported adverse effects
Unsold cannabis products suspected of being contaminated are quarantined or destroyed according to regulation and the operator’s established standard operating procedures.
Recalls issued by the NJ-CRC will include the following information:
- Product name
- Manufacturer
- Batch number
- Manufacturer date
