Frequently Asked Questions

HOW DO I GET A CONTRACT NUMBER?

A contract number cannot be obtained by a telephone request or by completion of the eRFP Notification Service.

A contract number is assigned ONLY when a vendor has submitted a bid in response to a Request for Proposal (RFP), complied with the requirements of the RFP, AND is selected as the successful bidder.

A contract number may be used only for the goods/services specifically described in the contract.

Refer to How to Do Business with the Division of Purchase & Property for more information on the bidding and contract award processes.

HOW DO I REGISTER TO DO BUSINESS AS A SMALL BUSINESS?

To register as a small business please see http://www.nj.gov/njbusiness/contracting/

WHAT WORK IS SUBJECT TO THE NEW JERSEY PREVAILING WAGE ACT?

Prevailing wages are to be paid under the Prevailing Wage Act when the services are for “public work” defined as construction, reconstruction, demolition, alteration, repair work or maintenance work, including painting and decorating, paid for in whole or part out of public funds. The prevailing wage requirements also apply, whether or not the work is paid for from public funds, if at the time the contract is entered into: (1) not less than 55 percent of the property or premises is leased by a public body or is subject to an agreement to be subsequently leased by the public body, and (2) the portion of the property or premises leased or to be leased measures more than 20,000 square feet.

IF A STATE OR OTHER PUBLIC AGENCY USES MY FIRM THROUGH A STATE CONTRACT AWARDED BY THE DIVISION OF PURCHASE AND PROPERTY FOR WORK THAT IS SUBJECT TO THE NEW JERSEY PREVAILING WAGE ACT, WHAT PREVAILING WAGE RATE DETERMINATION DO I USE?

The firm should use the Prevailing Wage Rate Determination in effect on the date of the purchase order/contract issued by the public agency.

IF MY FIRM HAS BEEN AWARDED A STATE CONTRACT BY THE DIVISION OF PURCHASE AND PROPERTY FOR THE SUPPLY OF MATERIALS ONLY, IS THE FIRM SUBJECT TO THE NEW JERSEY PREVAILING WAGE ACT OR THE PUBLIC WORKS CONTRACTOR REGISTRATION ACT?

No, if your firm is strictly a supplier of materials performing no covered work, you would not be subject to either the New Jersey Prevailing Wage Act or the Public Works Contractor Registration Act.

IF MY FIRM HAS BEEN AWARDED A STATE CONTRACT BY THE DIVISION OF PURCHASE AND PROPERTY FOR WORK THAT IS SUBJECT TO THE NEW JERSEY PREVAILING WAGE ACT, IS MY FIRM REQUIRED TO SUBMIT CERTIFIED PAYROLLS? IF SO, TO WHOM SHOULD THEY BE SUBMITTED?

Yes, Certified Payrolls must be submitted to the public agency awarding the contract or purchase order.

WHO SHOULD I CONTACT IF I AM UNCERTAIN WHETHER A PROJECT IS SUBJECT TO THE NEW JERSEY PREVAILING WAGE ACT OR THE APPLICABLE PREVAILING RATE OF PAY?

Contact the Division of Wage and Hour Compliance in the New Jersey Department of Labor and Workforce Development at (609) 292-2259 or (609) 292-2283, or go to their website at http://www.nj.gov/labor/lsse/lspubcon.html.
