NOTICE OF PUBLIC HEARING AND AVAILABILITY: PROPOSED RULEMAKING REGARDING THE ENHANCED INSPECTION AND MAINTENANCE PROGRAM (N.J.A.C. 7:27-15 and N.J.A.C. 7:27B-5)/PROPOSED STATE IMPLEMENTATION PLAN (SIP) REVISION The New Jersey Department of Environmental Protection (the Department) recently filed a proposal that would modify the State's enhanced I/M program. The program modifications include changing the start date for mandatory on-board diagnostic (OBD) inspections from January 1, 2001, to January 1, 2003 and establishing the framework for a "phase-in" of these inspections. Other proposed changes include continuation of the initial emission standards beyond their current end date of December 31, 2001 and the addition of a number of "interim" standards, effective January 1, 2003, in place of the current "final" standards. The proposal would also eliminate references to the evaporative pressure and purge tests and would add new OBD inspection procedures. Finally, consistent with rulemaking by the New Jersey Division of Motor Vehicles (DMV), the proposal would change the test to be used for certain vehicles registered as school buses and inspected by the DMV's school bus inspection unit. Those school buses that would have been tested biennially (every other year) with the dynamometer-based ASM5015 test would instead be tested twice a year with a 2500 rpm test. This proposal is reflected in a proposed revision to the State's Enhanced I/M Program SIP that was forwarded to the United States Environmental Protection Agency (EPA) on December 31, 2001. The proposed SIP revision also reflects that portion of the DMV's proposed school bus rulemaking relating to the emissions inspection of school buses otherwise subject to the enhanced I/M program requirements. The Department's proposal will appear in the January 22, 2002 New Jersey Register; the DMV's proposal is scheduled for publication in February, 2002. These proposals and the proposed SIP revisions are now available for inspection, as described more fully below. A public hearing concerning the proposed SIP revisions, the Department's proposal and the relevant portions of the DMV's proposal is scheduled as follows: Monday, February 25, 2002 at 10:00 a.m. This hearing is being held in accordance with the provisions of Section
110 (a)(2) of the Clean Air Act, 42 U.S.C. § 7410; the Air Pollution
Control Act(1954), N.J.S.A. 26:2C; and the Administrative Procedure
